Ahh I see. Heads on spikes. Hopefully this thread is the equivalent of me putting their head on a spike.

    Exactly.
They fought aggressively at the end on costs. They said my costs were disproportionate given that it was a claim for £100. The judge said that it wasn't given that they were claiming for £175 in total when they add on the court fee and their solicitors costs.

Pathetic. Your costs are what they are. You didn't ask to be dragged to court to defend yourself against their trumped-up case! There's only one party whose actions have been disproportionate.
They also said I should have switched the case to a court in London where I work but the judge said there was nothing in court directions that would have given me that option.

I'm pretty sure he's right there, you can only get it transferred to the court nearest your home. ParkingEye and their legal pygmies make this shoite up as they go along!
The judge did question me on the £90 as I was employed rather than self employed. But I said that my company had a flexible holiday scheme where you can buy and sell holiday and had I not taken the holiday I would have been paid for it. But he said that he could see no other way I could have got to Swindon cheaper than the £34 in fares I was claiming.

So an employee who isn't able to monetise his holiday simply has to sacrifice a precious day's holiday because of ParkingEye? That sucks big time!
Their solicitor said that I had send them loads of documents and had not mentioned these costs and they had not had a chance to see them beforehand. I countered that I had not send them loads of defence documents - my bundle was 11 pages.

Geez, what will the scumbags think of next? I don't suppose you even knew what your costs would be when you sent your defence.

A lesson to all those appealing or going to court. Do your homework and don't just copy templates verbatim. Check out signage and as OP did, get the details of where the PPC is deficient when possible.

And the advice about dressing properly and coming over as truthful will always help in court.

And have evidence of your costs as well for when you win.

    Congratulations again.

and to anyone reading this after receiving an unlawful parking ticket, the best way to get rid of these things is not to ignore but to try and get rid of it at the earliest opportunity.

As this is/was a multiple retail park, it may be possible to make a claim against the land owner?

Indeed, If I were ever taken to court by a PPC, I would wear my uniform.

Was this in Swindon county court? If so, well done. This is normally a motorist's graveyard.

I presume ParkingEye didn't mention Beavis was being appealed either.

  • Fab result Cygnus, well done, another in the eye for the bullies.

Parking Prankster would be more than interested to hear from you, I'm sure.

We had a similar experience with PE's lawyer when we went to court, think she was called Ms Vibond.

I was just about to log off from here but this thread caught my eye.

It has brought a smile to my face.

    Well done.

These PPC really are the scum of the earth, but they know that I suppose.

Sounds like some kind of Dom!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Flemming way?

If theres a coffee shop on site and you overstayed as a result of using the facilities on site then theres something wrong with parking eyes operation. ( although that can be said as a whole parking eye etc do not care about parking management - only maximising their profits from the sites that they infest.

if this is the flemming way site, then the Range/Halfords are just tennants and could possibly be equally !!!!ed off at parking eye as you ( well maybe the local managers )

    Is this the site? http://www.londonmetric.com/~/media/Files/M/Metric-Property/our-properties/retail-park/Swindon.pdf

Yes, Fleming Way Retail park. According to their heavily redacted "contract variation", the owner is indeed London Metric but it is Savills Commercial who are their agents and who signed their contract.

Also I have just clicked on your link and they have digitally touched up the car park. There are no trees on the islands.
