Yesterday I received a 'notice of intent' which states that this debt will be passed onto a debt collection agency. The appropriate agency will seek a court order instigating the recovery of this debt
In reply to my letter from Monday I have received one today.
The letter states "Whilst inform you that the date of the incident and date of your complaint is now greater than 29 days which under schedule 5 of the protection of freedoms act 2012 this would render you the registered keeper of the vehicle liable for the drivers action and even though we are no longer a member if the bpa, you would have lost the right to appeal under popla and therefore we would have satisfied all of the schedule 4 criteria regardless and we now believe we have the right to recover any under paid parking charges from you the registered keeper.
in light of the above, perhaps you will understand why the pcn was issued and although I really do sympathise, I just stress that we are contracted by the landowner to enforce the terms and conditions that are stated in the signage at the location, and in these circumstances they have been breached. I can only suggest that you make prompt payment to avoid incurring further costs in relation to any potential debt recovery and/or court proceedings" and it is signed by N Martin who I believe you referred to as Trev's imaginary friend?

new one on me , since when can a debt collection agency do this ,
on second thoughts he's missed out the bit about actually going to court before this court order instigating starts

Debt Collection agencies - not being an actual party to any alleged debt - cannot take legal action against you.
Strictly speaking, only the landowner can do this. At a push, ANPR Ltd might try, claiming their contract with the landowner allows them to do this, but they'd be pretty stupid, given their current position.
They're not even right about what they've said about schedule 4 of the Protection of Freedoms Act, so I doubt very much they'd want a judge to look at their behaviour to date.
They're just trying to scare you into paying, it's the only tactic they've got left.Je Suis Cecil.0 -
Just ignore the idiot. You will get a set of court papers in a few weeks that are supposed to be an example of what they would look like if submitted. Trev then gives up and goes away.0

I feel really threatened by them! I'm currently applying for a mortgage and I'm worried this is going to affect things if I have outstanding 'debt'.
My next step is to ignore all letters from anpr and any debt collectors. Will this get taken to court??

court is unlikely but cannot be ruled out and they have 6 years to try to bring a claim
this cannot affect your credit rating at the moment, that is an urban myth
they would have to
take you to court
win in court
you fail to pay the judgment within 28 days
then they can issue a CCJ and enforcement
that is when your credit rating would be affected

its an LBC or MCOL from anpr or the landowner you need to deal with , until then , you can and should IGNORE THEM (including their silly attempts at fake court papers and Expedion debt recovery - all the same fake ANPR LTD trickery)0
