but if there in plain intelligible language then they dont have to be reasonable
if the arnt subject to common law then they dont have to relate to cost
so in my opinion banks have won because they can charge what they say, if its in plain inteligible language. which is what judge says it is. reasonable only enters into it if it isnt in plain inteligible language.
the common law argument has also gone so were all screwed.

Because he said that they were subject to unfair terms in consumer contracts regulations, it means that they now fall under the juristiction of the OFT. Subject to an appeal, the OFT must now decide what the charges should be. They decided £12 was fair for credit cards.
But as Martin as pointed out many times, the regulations clearly state that these charges should reflect the true cost to the bank. The costs are said to be around £2.50, so anything above that is still unfair, which is why credit card companies are still having to refund the lot.
As it stands, this is a victory for the OFT and customers. But only if the banks roll over and accept it, which many think is unlikely.0 -

they can accept it because it means nothing. they wont because its better for them to keep it going with us all in hope awaiting an outcome in our favour
but then that outcome isnt what most people think it is

Everyone has a choice in life, make mistakes and you pay penalties. As so many peeople have said get a basic bank account which cannot go overdrawn. Some of the morons on here including yourself need to stop whining about other people not paying there way and get on with it0 -

so why should we give you a free ride on your banking obligations. you should pay for what you use. if you make a payment or withdraw cash why should i pay for that for you?
take responsibility for your use of use of the banks.

Yes it can. Especially after a bank has applied a charge for refusing to pay out. Thus, if you issued a cheque for 10p and had 5p in the account the bank will charge you a)£35 for not paying your cheque and b) not meet the cheque either. So, if you have a Basic account you are caught twice.
