  • We have won two claims in court against LTSB and are about to complete the N1 for our sole trader business account - what do we do now?
    How are business claims affected by the test case? Any help appreciated!:confused:
    Have you received a reply from LTSB on the business account? I have a partnership account and a Limited Company account with LTSB and wonder if I can claim charges on them. Does anybody know?
  • I have just received a letter from LTSB dated 25 July and I quote"Generally we don't agree to adjust these charges, but I can tell you on this occasion we are prepared to repay you £750 (original amount including interest was nearly £6000) in full and final settlement of your complaint. We will credit this amount within 10 working days". I think I will just wait the 10 days to see what happens and if I receive the £750, then write to them advising that I can only accept as a part payment and that I am pursuing the remained claimed through FOS. Does anybody have an opinion?
  • I have already received a cheque from Yorkshire Bank they have paid £1000.00 short should I accept and bank this cheque, I have put a proposal forward to medet them half way for a further £500. but have had no response, due to the situation now I am inclinde to bank the cheque. I have a date to go to court in August what would you advise me to do.

  • I have received a cheque from Yorkshire Bank for part of my claim I have not banked the cheque as this would then close my case. I have a date to go to court at the end of August. My claim was for £2.700. they have sent a cheuqe for £1.695. I have responded to them offering to split the difference of a £1000.00 saying I would settle if they send me a further cheque for £500
    due to the circumstances I am inclined to accept there offer. Would anyone advise me what I should do.

  • Hi all, I was wondering if someone could help me...and I apologise if this has been asked elsewhere!

    I wrote to Natwest reclaiming the charges two months ago, and got the standard letter from Stuart Higley advising me to give them the standard 56 days, etc etc...I then called them about two weeks ago, JUST BEFORE THE OFT RULING!, and asked them about the progress - they said that I would get an offer letter in the last week of July...

    So I was wondering this: in Martin's latest update, he mentions that the Social Security Administration Act 1992 says banks cannot take charges from benefits, and he also said anyone in this situation should ask their bank to continue the complaint...so my question is this; does this mean that Natwest is still obligated to pay out the reclaimed charges?

    I'd appreciate any help from you guys, thanks!!

    Can anyone else confirm that this is correct. On 26th July I received an email from Natwest stating that my claim has been verified and an offer letter has been prepared which I should receive in the next ten days. I rang them on the 28th and was told the offer letter had been sent on 24th July.
    The offer letter still hasn't arrived and they have now said that they will only honour my claim if I received a letter.
    Due to the fact that I have an email that states the above, if someone can clarify that this is the FSA stance, then I can email them again and tell them this.

    hi , can any one tell me if this is the case: that if your bank defended your case or acknowleged it before the 27th july they have to continue with it?

    i have been doing this since jan & i now dont want to have to wait until nxt yr:confused:

    ive filed with mco against nationwide they have acknowledged and had till the 5th to put in a defence have you any idea if this case will still continue or if they wil still pay out thankyou

  • Ive done all the MCOL thing, amended my details in my local court because i filled the particulars of claim in wrong. Then i got a letter from the court informing me that i had to send a copy of my charges and my updated particulars of claim to Cobetts solicitors which id already sent (recorded delivery). The court letter said that the Bank now had 14 days to reply to me with an explanation of the charges that they took from me. I havent heard anything yet so i wrote to the court asking for the jugde to enter judgement. Has anybody any idea whether i could expect to hear anything soon or do i have to wait for the High court case?
