" Social Security Administration Act 1992, which says that banks must not take charges from benefits as this money is needed for a person to live on. "
Does MA (maternity allowance) and child tax credits count as social security benefits?0 -
New to this but been doing some digging around and shouting then correct complaining. So far I have complained to:

complain to the FSA about waiving their complaint process (as if they ever did it in eight weeks anyway)

OFT - For allowing the waiver and ombudsman to stay their cases - they are a government office set up to look after the consumer not a business.
FOS - for staying all cases, the courts have not, they are looking at cases on an individual basis.

I have also taken this up with my MP who is complaining on my behalf - nice bloke!
I was talking to a friend who works in the Bank Charges Dept at Lloyds, he advised that they feel that this stayed period will not last for long and are taking this time to sack contractors and train their own staff to deal as they were losing money hand over fist. He also said the Ombudsman were of the same opinion, that once too many people start to complain - they will have no option other than to start cases back up.

I phoned Barclays today to try to push the 'hardship' route as I am deeply in debt. They inform me that they have never heard of such a clause and that ALL cases are on hold. I will query this in writing, but wondered whether anyone can poin tme in the direction of evidence for this. Thanks.0

Can anyone help me plse? my son sent the reclaim letter to Natwest Bank in Dec 2006 & received a reply from Stuart Hingley on 18th January 2007 stating that they were investigating his claim.On 6th March my son sent another letter stating that as six weeks had passed with no response he would take legal action in 14days if he recieved no reply. Needless to say there was no response but before my son could proceed he had to go away so nothing was done.What should he do now,write again or wait until the outcome of the OFT test case?0

I would fight on, basically what they have done is not complied with the 8 week rule. They should give a full and final decision within 8 weeks.......they can advise that they are sorry they have not dealt yet and will be looking into as soon as possible......but 7 months is too much. Kick up.....complain to the fsa oft fos all emails for them are above.0 -
Hi, I put a small claims against my bank for my charges, soon after my bank made me a goodwill offer which did not include the court fees so i wrote them back refusing the amount because of that. I have not heard anything from them since and now this test case has begun.
Any ideas about what i can do?0 -

More on hardship.
If your bank will not take your claim, contact the Financial Ombudsman to tell them you are in hardship and your bank is not helping.

Hi, I issued my claim with money clain online on the 25th of july it was accepted and then i recieved a letter saying it was served to nationwide building society on the 30th of july. will my case get put on hold or be heard as it was issued before the 27th of july?
Any help will be appreciated

What happens in situations like mine, the Halifax were due to send me an offer by July 25th, I rang on 26th saying I hadn't received it, they were apologetic and said I would receive in next few days. Now I have been told all cases suspended until court decision. The Halifax agree that they promised me my offer by July 25th, but despite me arguing my case, they say there is nothing they can do. Is this the case?
Im in the same situation Natwest wrote to me too say they would give me a decision by the 12th of July and i never recieved any thing from them.
When i rang the bank the man said that he could'nt deal with unlawful bank charges but he could'nt give me a number that could either.
When the OFT made their anouncement i rang the bank again who were very apologetic and said that there maybe a letter in the post but with the OFT anouncement he did'nt think it was likely. Where do i stand as Natwest had promised me a decision 2 weeks before the test case went to the high courts.0
