Hi there, i wrote to the halifax 3 months ago to reclaim my bank charges which they then replied the usual telling me that they would investigate and let me know within the 8 weeks, they did reply saying there sorry but they would not refund at all.
where do i stand now with the OFT test case. will i be able to try reclaiming again.
your help would be much appriciated0 -
I've sent all my letters to the bank requesting my money back, had all the usual replies, my next step was to apply to the court etc. Can I wait until the test case and then submit my claim or will I have to start the whole process again?

I received an offer from Barclays a few days ago, which I have accepted and sent back relevant form. I am hoping this will still be credited to my account, in light of everything that is going on now, I am a little confused! Can anyone answer this one????0

If you are about to go to court, local or via MCOL, you must continue with this to keep your claim in the system. The bank will tell you they have suspended all claims but your individual court may or may not proceed with claims and they are the people to ask.
The banks will and must honour any offers that were made before claims were suspended.
If you already have a court date, it is important that you plan towards this still going ahead and prepare your court bundle etc. If your claim is in the MCOL system it is more than likely that your bank will acknowledge/defend and you will then hear from the court when it is transferred to your local court and will get further directions from them.

What happens in situations like mine, the Halifax were due to send me an offer by July 25th, I rang on 26th saying I hadn't received it, they were apologetic and said I would receive in next few days. Now I have been told all cases suspended until court decision. The Halifax agree that they promised me my offer by July 25th, but despite me arguing my case, they say there is nothing they can do. Is this the case?
Hi I was toldexactly the same, so I rang the FSA, they told me it was not true, if your claim had been acknolwedged prior to the 27th either, verbally or written they have to proceed with it. I rang the Halifax back, and they settled there and then over the phone. Good Luck0 -
thanks edinburghlass, I havent had to go as far as going to court thankfully, after only 2 letters they came back with an offer at the weekend, I am now worried they wont go through with this and credit my account within the time scale of 2-3 weeks.0

At the end of May 07 I applied for a list of all my bank charges within the last six years but it still hasnt arrived - I spoke with Halifax last week + they said it should have arrived by me by the 10th July at the latest so they request a priority/urgent list to be sent to me saying it should take between 7-10 days and it still hasnt arrived.
Also I have received a letter from Halifax saying they are prepared to offer £500 as a gesture of goodwill but I phoned them to say I couldnt accept this as I still hadnt received the list of bank charges to compared it to.
Does anyone know what the Law is involving them getting me my list of bank charges to me in time? + what should I do about the offer as well considering that all cases have been put on hold ?

like me some of the claims we have processed paperwork wise will still be in the post thanks to the so called post workers going on strike again!!
as i have spent "120.00 already to get things moving do i need to spend anymore cash to get the case heard in court? i hope not as i am totally skint!0 -
I have a date for court which is in the next two weeks,, but i received a letter from the banks solicitors on the 26th June stating that their client was "minded into a settlement" I'm now awaiting to hear from them after sending them the information they required. Do you think my case will be stayed?

I am wanting to claim back bank charges but my husband has his business account at the same bank. He is concerned that the bank could not only close our account but also cause problems with his business account. He says they ask for his overdraught facility to be paid off, which he feels will happen if we go ahead with bank claim. We cant afford to do this if they do.please advise and thanks for the never ending info on the site.Its really helpful.0
