    I recently sent of my letter to Natwest claiming nearly £3000 back in bank charges. Two weeks ago I received a letter stating that they were lawful charges and that the claim would be put on hold because of the pending case early next year. Just wondered what I should do now, will I have to wait or can I contiue with the claim?

    I went to court yesterday and to my suprise someone representing the woolwich turned up!!! dont let that put you off.
    The defence seemed more nervous than me!!
    Even though the case was put on hold until after the test case.If the defence hadnt attended I was told that I would have won!!:rolleyes:
  • i sent all letters to bank using templates some months ago and they replied with a big fat no, saying that charges are fair and that i agreed to them when signing up to the account. I was going to take them to small claims court but never got around to it damit!!! Even though this was several months ago should i still make the claim now, knowing it will be put on hold.
  • The bank has issued a default notice to my credit rating for a deficit mainly comprised of bank charges which forced me to open an account with a different bank. I have received an offer of £7,300 in reclaimed bank charges. The initial claim was £12,400. The default was issued after i started claiming. Can i do anything about this or will i have to live with the default for six years. I have already been refused credit due to this.
  • I have just phoned my bank re a couple of charges on my account - they will not refund anything until the court case between OFT and the Banks has happened !! I said the charges were due to them posting charges in the 1st place taking my account £24 o/d and they have subsequently charged me a further £112. On top of this on another account they have charged me £38 for not paying a s/o of £12.50 although I had over £1000 in another account also in my sole name only !!!
    I am now unable to cover other bills as a result and therefore will be taken to court for non-paymt of those but all they kept saying was 'we are not refunding any charges until the court case is heard in a years time !!! ' so in the meantime me and many others find ourselves in a worse position financially we need to be. SO if the court case says its illegal and all charges have to be refunded for the past 6 years automatically - will this also mean that they will clear any CCJ's etc that some people have got !!

    I have now decided that I will reclaim all of my six years worth now - wasn't going to worry too much before but because they are being !!!!!! will start the reclaim now - despite it being on hold.
  • Hi Guys - hope someone can help

    I sent my back a letter on 12th Feb 2007 and i took until 7th Nov for them to send me my list of charges.

    I have sent them a letter stating as its taking so long i will take them to the small claims if they don't reply as normal (even though the test case is ongoing)

    What shall i do if they don't bother, shall i take them? The reason behind my thinking is that i put my request in on Feb 12th which means if the bank had replied in the time it should have i could have had the case settled before the end of April which is before this test case and the waiver was signed by the banks.

    Anyone got an opinion?
  • I was wondering, supposing the OFT win the case against the banks and these charges are ruled unfair does that mean people can now claim beyond six years? Or are we still stuck with this six year limit?
  • :mad: Lloyds TSB have acutely bothered to file a defense, just my luck, details to follow when received.
  • I sent my first letter this week asking for bank charges refund I got a repl 14 days later saying it acknowledges my letter but says the charges are fair and lawful. Then it goes on to say my case cant be dealt with as the bank being Natwest is in legal proceedings the the OFT and says once the proceeding are over with my case can be dealt with. What do I do now any one help please!
  • Hi,
    You can't do anything but wait until test case is completed and hopefully ruled in our favour. I've just sent letter to Abbey and am waiting reply to confirm they have received letter. They should hold your letter on file and deal with it when OFT test case ends.
