Yes, you can still claim up to 6 years back.
    Thanks very much. :T
  • i REquested and paid for my statments from Halifax bck in March although i received a letter within the 40 days i still have not got the statements I paid for. the only number provided goes to a recorded message! what can i do now?
  • We sent a letter to Barclays back on June 4th after chasing for months for the list of charges (statements). We were claiming £1025.03 plus interest charged on the account for going overdrawn as we refuxed to pay their exorbitant bank interest charges.
After hearing of the pending court cases we didn't expect to hear anything until next year. However a letter has arrived from Barclays offering £275.00!!
I rang them they will not review it and said either take it or lose the offer there will not be another.
    HELP!!!!!
  • I am an interested party to these proceedings as a mum/ MiL I would like to help my children as they are struggling to meet their financial obligations and occasionally go ever so slightly over their overdraft limit. They have been charged £36 for going 18p over, and £60 for going £7 over. I find these charges outrageous and morally abhorent, the Bank is punishing those who can least afford it.
I have emailed Martin's page on reclaiming bank charges to them, and hope they will take immediate action. But some people are afraid of challenging institutions such as banks and feel they are on a hiding to nothing. Can I write to the bank on their behalf? Has anyone else done this?
if i had known then what i know now

There seem to be a lot of people on this board that have claimed on behalf of a friend or relative, so you should go ahead and log your claim. They're not being dealt with at the moment because of the OFT test case that has put a spanner in the works, but you should get the claim in anyway so that it can be considered with the thousands of others when the OFT case is over.
  • If neither my bank nor the county court have confirmed a stay, will the case still go ahead? should I check with the court or just turn up and hope for judgement to be awarded in my favour if they dont turn up? Anyone know the answer to this please?
  • If you have a court date you should turn up or your case may well be struck out and that will be that as it is you who is taking the bank to court. You should only go by a notification from the court, not the bank.

You can by all means help them but they must do the claim themselves unless they write to the bank giving you permission to act on their behalf.
  • Back at the beginning of august my bank didnt reply by the date given by the court. i rang the court and they told me i had won the case and i was to send in a request for judgement for them to pay up. this was sent same day. 3 weeks later i had a letter from the court saying all cases are stayed. (and the date was backdated a month) SURELY if i won this should be paid and not put on hold??? i have been fighting my cases since february!!
IS THERE ANYTHING I CAN DO?
  • I want to ask a question, don't know exactly how but here goes: If you have your business and private account tied up together can u still reclaim the bank charges? need to know as all I have read seems to just speak about personal accounts......help
