    Yes you most certainly can reclaim penalty charges from a business account, this should not even be affected by the OFT Test case either, however the courts may still stay the claim as there is confusion as to which types of cases should have stays applied. Credit Card and Business claims should not have stays imposed.
  • My parents have about 1000pounds in charges over the past year with alliance leicester, with all this going on is there much point in sending a letter in now with list of charges etc or should we just wait til test case?

  • the test case involves the Unfair terms in consumer contract regulations 1999 but i'm claiming back under the Bill of Rights 1689

    will it still be dealt with or do i have to wait to January
  • When I last telephoned Natwest I was given a verbal offer for all my charges that I am claiming against (£1500). I was told that I would receive an offer letter within 2-3 weeks. In week 2 of that time period the banks have out everything on hold whilst this test case goes ahead. I then rang the bank immediately and was initially told that because a verbal offer had been made, that they would still 'honour' the offer. After waiting another week for my offer letter and having heard nothing, I telephoned again to ask for an update, only to be told my case had been put on hold... I have written back to them outlining that they had already agreed an offer settlement which I was willing to accept - but have never heard anything back from them.
    Can anyone please tell me if I can get this money back or will I have to wait???
  • My business bank (LTSB) wrote to me to say that as my account was a business account I was not covered by the 'unfair contracts terms act 1977' & the 'unfair terms in consumer contracts regulations' as these apply only to consumers. This sounds like a load of bull **** to me and just another way to try and fob me off or is it true? To me a consumer is the user of the product and it should not make any difference if it is a person or person trading as a business. I am still using the banking services they provide.

    Any help or comments would be appreciated.

    it is irrelevant as to whether they are current or business accounts...you are arguing against the fact the the charges are punitive and do not reflect the true cost to the bank....why not write back and ask them for this breakdown as to why its cost you ex amount of pounds for ***. bet they dont answer you. In fact...pop yourself into your local branch and ask them face to face.
  • I have a Currency Account with the Clydesdale Bank in Glasgow and have my euro salary deposited there. I recently requested a small sum of 1000 euros be transferred to my current account with a Belgian bank. For this I presume elcetronic SWIFT transfer I was charged approx 85 euros or 56 pounds explained as consisting of a 24 pounds debiting charge a 15 pounds receiving charge and a charge of 17 pounds by an interim bank based in Belgium. Is this charge legal and has anyone else been stung in this fashion. I have taken the matter up with the receipting bank and been told by them that the transfer should have been managed as a EDP European Domestic payment in which case their charge would have been 6 euros not 22 as charged. Any advice most welcome please. Especially from Scottish web master. Edinburgh lass

    Hello all.
    Forgive me, the clue is in my name..I am fick/dumb/droopy..I was patting myself on the back when I got my court date thought I had done sooo well! Was prepared ready to go! Came back off my hols and then found my letter to say that the court had put a 'stay' on my case. Well thats it! Finished!
    But can someone help me...am I finished?
    What now? Can I do anything or must I wait? £1500 waiting on the line with Barclays!

    I'm new to the forum and have gone through the stages of claiming back my bank charges with ABBEY, up until the part where I have requested the bank to pay me what is owed (over £2000) but have now received the letter advising of the new rules and changes and how my claim has been put on hold until the hearing next year!!!I'm just wondering shall I go ahead with the next stage, applying to the courts , or shall I wait until the case has been heard next year!!!If anyone has any advice please help!!!Many Thanks x:confused:
