Timid wife but boy am I angry!

I know more than my wife about cars - but I hardly know anything - I am a biker. My wife isn't really timid - more doesn't like creating a fuss but in this case is learning she has rights and this car is/was sold in an obviously unsafe state as it failed the MOT 24 hours after it was sold.
Had the dealer done an MOT on sale as the ad stated, it wouldn't have been sold/bought0 -
So why wasn't the car inspected before you bought it? it isn't just down to the seller to detail everything that is wrong with the car. You have to ask questions and inspect the car yourself. Did you ask to see the previous MOTs before buying? Did you inspect the car or buy blindly? sorry to be harsh here but you have to take some of the responsibility here.
I really don't see why you should feel cheated or disgusted. The dealer is putting right what was wrong and giving you the car back - what exactly are you disgusted by and how have you been cheated???0 -
We were only allowed access to the documents when she picked the car up and whilst she was swopping documents and keys I then noticed the MOT date and queried it. It was at that point the dealer arranged for an MOT next day.
I have said I know very little about cars, I DID go around the car to check for rust on the places I (as a non motorist) would expect rust eg wheel arches and sills. The only sign of rust was on the ford badge on the boot lid and I said "we will have to see if thats just been painted over or had rust preventive put on it"
I think to have seen the suspension mount rust or the brackets holding the sills in place, you woulod have to have the car up on a ramp as well as know where to look for it.
If that is ignorance on my part, I am guilty however, I would have thought it would be an ideal place to look before I was selling a car if I was a dealer or at least get it MOT'd myself - after all there is up to a £5000 fine for selling an unsafe car and from what I gather, the MOT tester phoned the dealer yesterday in my wifes presence and told him this car is unsafe.0 -

yes, if it was advertised as coming with a years MOT then yes it would be fair to expect a full one! did you ask why they hadn't? Were you expected to pay for the test or did the garage? Just seems strange that they still let you take the car rather than give you yours back until they had tested it and made sure it was ok. did they give this as an option when you were there or was it not mentioned?0 -
I'd be wary of any dealer who wouldn't let you view the MOT certificates etc. until keys were being swapped and the deal was effectively done.0

His excuse was that "he was rushed by my wife as she wanted the car" so he forgot the MOT. Yes he paid for the MOT.
Latest news is.......he brought the car back personally to our home this afternoon. A local garage (his choice) have welded the sill and MOT'd the Ka today. I wasn't here when he came. As we had NO idea of what work was done I suggested my wife phoned the garage (not the dealer) and asked what they had done and if we could have written details of what they had done exactly - the man refused saying that the invoice will be sent to the dealer.
Moments later, the dealer phoned us and I answered the phone. I asked him "What has been done as we have no idea" He told me the sill bracket had been welded and the car MOT'd. I asked "So what about the front suspension mounts that were on the advisory, they are no longer on the advisory list - have they suddenly repaired themselves?" He said the garage who did the MOT and repairs did all that was needed for a new MOT.
The thing that worries me is that the garage is not the same one who failed it recently. I told the dealer that I am worried that these items no longer appear on the MOT, so worried that I think we will pay the RAC for an inspection.
At that point he offered us our money back saying he had two other people who wanted the car anyway. Like a fool, I handed him over to the wife and she agreed to keep the car.....because she likes it!!!

Big mistake you made in keeping the car,
1) the bracket has been bodged you dont weld brackets you should replace them with new ones.
2) The missing advisory's have vanished due to the dealer getting his dodgy m.o.t tester to overlook them as he probably gives him regular work
3) As soon as the RAC inspection was mentioned its funny how he would take the car back asap - its probably got lots more issues
He could not careless about the safety of your wife and the passengers she will be carrying
One point to think about is how would you fell if god forbid she was in an accident and the car didn't hold up well due to any faults that cant be seen. The mot guy and the dealer couldn't care less as long as they made some cash
Personally id give the car back purely from a safety point of view its just sad to see that dodgy dealers give a bad name to the decent ones out there“People are caught up in an egotistic artificial rat race to display a false image to society. We want the biggest house, fanciest car, and we don't mind paying the sky high mortgage to put up that show. We sacrifice our biggest assets our health and time, We feel happy when we see people look up to us and see how successful we are”

Local council testing centre and/or VOSA (whatever their new name is I can't recall) first thing in the morning. Ultimately though give the dealer an opportunity to give you your money and car back, if this is a bully boy little pitch (and he certainly doesn't sound professional) you may end up with slightly bigger problems than a failed MOT. Xx0
