    you can't start divorce proceedings until you have been married for 12 months.
    You could, if you wished, try to negotiate a formal deed of separation with a view to it being made into an order as soon as you are able to divorce.

  • Given you have not been dating that long you probably do indeed qualify for a short marriage ruling and you should not waste time getting legal advice.

    Ok today she has texd me saying I cannot come to the flat.. she states she wants me out until the 31st jan as she is doing her dissertation and I am absusive... she is totally mad as I have been really supportive and she is lying...

    See a lawyer urgently.

    She is trying to get you for harassment and then get you out of the flat.

    At a guess I would say that your wife realises she has no beneficial interest in the property so is going down the route of saying you're abusive to get a court to grant an order to allow her to remain the property. Go and seek legal advice. You might also want to try making an appointment with a family mediator or something.

    The point is that she has already got a lawyer and is prepared to do anything to fleece you. If you do not protect yourself, she will make life difficult.

    Much better to get this sort now than to spend months getting her out AND then finding she has stripped the place.

    If not, u should state clearly that there is no abuse. That you will continue to live there and that you are looking to file for divorce.

    She is free to leave if she chooses. Have a camera handy. And say nothing to her.

    Speak to a solicitor.

    Send her no more texts, calls or emails than that 1.
