Landlord refusing to allow me to move on tenancy end date

Hi!
I wondered if anyone could help me?
My tenancy end date is set as the 31/01/15 as it states in my tenancy:
TERMS OF TENANCY-EXPIRY DATE- 31/01/15 (to & including).
Problem is, my landlord is refusing to allow me to leave this date and requests that I either vacate a day early (meaning I lose a day of my tenancy AND lose money as I would need to take a day off work) or that I leave on 02/02/15 and pay them extra rent (again losing me money as I would need to take a day off work and have to pay more rent).
I have told them that I am entitled to leave on my tenancy end date but they are refusing this. What can I do?

Just leave before the end of the last day: That is your right.
Take loads of photos (not too high a definition if you get my drift..), with a witness:
Make sure you return keys etc & take meter readings & get proof of both...
If the landlord then tries to sue if will lose (IMHO..)

The question is not what you can do, but what they can do, which is nothing.
Just leave on the last day of your fixed term tenancy if that is your plan.0 -
Any idea WHY?
What date does your tenancy actually START? In particular, do your monthly periods start on the first of the month?
The general answer is that yes, if you are no longer occupying the property and have thereby surrended the tenancy then the tenancy ends on expiry of the fixed term. It's not a matter of opinion.
But those details are important.0 -
Well, the 31st is a Saturday.
Thus, obviously, the day before is a Friday and the 2nd Feb. is the Monday after the week end.
Could just be a case of not wanting to deal with it on the weekend for whatever reason (inventory clerk/agent does not work on weekends?)0 -
The reason they are refusing is because their offices aren't open that date and therefore they can't do 'move-outs' on a Saturday.
I'm all for moving out on that date and I will take pictures etc. but the difficulties lie in where to hand in the keys. I have been to the office before when the office has been closed and they have shutters down which cover the letter box so I would be unable to post the keys until the monday0 -
Post the keys back in through the letter-box of the property you are leaving - get photos & witness...Then email agency with picture ...

Maybe as the 31st is a Saturday. OP to make the end date clear you really should return the keys so I'd suggest you ask how the LL wants them returned on 31st. If it's the checkout inspection he cannot attend on the Saturday perhaps he can arrange for it after the end of the tenancy. I'd always prefer as the tenant to be present but it's not essential. No reason why the LL can't invite you back say Monday evening or whatever to witness the inspection. Take you own photos etc. in case of dispute over the condition.0

Not your problem if they haven't put a (probabably unenforcable) you can only end tenancy on Mon-Fri in the contract.
Suggest to them that if they try to bill you for the extra days you'll see them in court.
Very good advice about the photographs - a friend got stitched up by her landlord who claimed she had wrecked the flat .......and produced photos (undated) from several years earlier when the previous alcoholic tenant had moved out-when she took him to court to get her deposit back. This is what I intend to send to them:
I do not intend to move out on the date of 02/02/2015 and pay extra rent, neither do I intend to move out of the property early on 30/01/14, as you suggest. I will be moving out of the property on 31/01/2015. Please note that I am legally entitled to move out on my tenancy end date and this is my intention. Your firm can not lawfully refuse me my right to leave on my tenancy end date so this is the date I will be moving.
If your firm are unable to attend check out/ inspection of the property on this date then please inform me as to where I am to post my key and I will make arrangements for this. It would be appreciated if a checkout inspection could be arranged with myself being present after the end of the tenancy if this cannot be arranged on 31/01/14.
