    I can't specifically say that a bank statement will be enough but it will show that you were in Sainsburys and Costa on that day which I would have thought would be proof enough.

    I contacted Mr Whitely with my above complaint and he said thank you for the note but that he found my tone quite aggressive? Sadly not as helpful for me and he directed me towards appeal and asked me to contact him if there are any issues with it.

    All rests on appeal though I may fire off a Facebook message to Sainsbury's.

    That's a shame dammit, it didn't look overly aggressive to me.
    But don't get despondent, even if the initial appeal is rejected, most of these get sorted at the POPLA appeal stage and there is some comfort in that Euro Car Parks are not known for doing court action.

    Coupon-mad hasn't been online since your last question. Hopefully when she comes on she will answer and you can fire off your appeal which can be sent online except the final paragraph should be amended. I changed the final line of mine to read "This is submitted online so I have kept a copy and this communication is clearly received by you unless proved otherwise. I look forward to your considered reply within 35 days". It should be aknowledged fairly quickly.

    Thanks Bob, that is reassuring. I felt a bit bad for shooting myself in the foot with a potentially helpful person. I was a bit surprised that he didn't seem in the least bothered re: Equality Act. I've apologised for my perceived tone but my complaint still stands.

    I'll submit my appeal online tomorrow latest with your edit and any further comments from other posters. Or I'll just remove the part about the 14 days.

    Just had this reply from Mr Whitely in response:


    It always frustrates me when people quote acts when they have exceeded a time limit instead of simply explaining their circumstance.

    There is no need to do so as all it generally does is back the recipient into a corner.

    For the record we implemented the maximum stay not to penalise genuine customers but quite the opposite and aide them finding places to Park and to stop fly Parking by people not using the centre.

    Whilst the maximum stay is in place there is always an element of tolerance on the timing and in fact have had very few issues with any member of the public irrespective of age or status.

    There are a significant number of signs detailing the time limit, more than is necessary and on the whole people have adhered to them with very little negative responses.

    Please let me know how your appeal progresses.

    Dear Mr. Whitely,
    Thank you for your response. I am certainly following the appeals process with your agent Euro Car Parks (ECP). Knowing how these private parking companies work (they only really want the money - they don't really care about circumstances) I fully expect they will reject my appeal. I shall then take this to POPLA and fully expect to win (which will cost ECP £27 in the process).

    If by some miracle ECP win the POPLA appeal then court action will be required to force me to pay the speculative invoice; I will vigorously defend any such action, and will use the Equality Act 2010 as part of my defence. I will also reserve the right to counter-claim for "injury to feelings" (a valid claim reason under the Equality Act) caused by your agent's actions - such a claim will have ECP and Savills as co-defendants and the starting point for such claims is £500.

    All this time, effort and stress can be removed if you instruct ECP to cancel this PCN, so I call on you to reconsider your present stance.

    Wish I'd seen this before I replied! He hasn't responded to any further emails despite my apologising for my "aggressive tone" so I think I've just got his back up now and he's decided not to help. Kicking myself!

    Bob got a great response so I think the lesson to any others appealing for Bretton Centre is to just politely explain their circumstances and attach any receipts.
