Mail Plus, Daily Mail, MOS, Kindle - is it a scam?

So still saying a better version than last year ... the same device again is not a newer version or upgraded version.

That is not reflected in their latest message that states
"After discussing your case with our senior agents, we have concluded that at no point did we specify which model of Kindle you will be receiving.
Customers who purchased a second Kindle offer were informed they would recive a new Kindle, however we did not say it would be the newest Kindle model."

I've told them they're right and I'm not eligible so please refund my money and arrange to collect the Kindle.

Hmm... a newer "version" strongly suggests to me that they are offering a more recent model.
I'd look into that, sue them in the Small Claims Court if necessary, and create one hell of a lot of bad publicity for them (nice start by posting here!).
No reply from the Daily Mail (Mail Plus).

BEWARE - IS THIS A SCAM?
I accepted last year's deal for a "Free" Kindle for a year's subscription that has now ended and was sent a renewal offer of
"Just pay £119.88 and we'll send you a newer version of the Kindle Fire HD 7" 8GB device we gave you last year."
I received an identical model, same "Third Generation Build" and storage capacity, so I contacted Mail Plus and asked for the upgraded model or a refund.
Mail Plus (Luke Richards) insists that "The latest Kindle you received has updated software and the format has also been redesigned."
I maintain that there is no significant difference but Mail Plus disagrees, although they can't seem to specify what the updates are.
I'm a pensioner and feel I have been conned by the Mail.
Any advice would be welcomed
The Daily Mail / Mail Plus people still say they've not been misleading and aren't prepared to refund my money.

Have you sent them a letter before action (LBA) yet? If not, do so (if you really do want to return the tablet and get a full refund). The LBA needs to state what you require and when you require it by - e.g. a full refund within 14 days. If they don't comply then you'll raise a claim in the small claims court, and add the cost of this process to the refund you're seeking.
And if they don't react to the LBA, file a small claim at MCOL )Money Claim Online).0 -

I'm reluctant to go that route at present as we're not in the best of health and also because The Mail are still responding
Their latest message (Josh Armstrong) said
"At the start of the offer, when you originally placed your order in October 2013, we were supplying the second-generation Kindle Fire HD. After this model was discontinued we switched to supplying the third-generation model.
The automated email you received offering an upgraded model was targeted specifically at those of our customers who had originally purchased the second-generation model; that is, the upgrade referred to in the email was the upgrade from the second-generation to the third-generation model".
I've replied
"The second generation was 16GB.
Your offer was for an upgrade to the 8GB, which means it was for the third generation
"Just pay £119.88 and we'll send you a newer version of the Kindle Fire HD 7" 8GB device we gave you last year."
I've not yet had a reply0 -
It's surprising there doesn't seem to be anymore complaints to be found as I'm sure there would be thousands of unhappy people.0
