ANPR LTD denying me a POPLA code?

I received a PCN on the 30/09/2014, and followed the advice to wait until the NTK. This arrrived late, on the 26/11/2014 - 59 days. I sent an appeal letter taken largely from threads and Parking Cowboys on the 05/12/2014.

I have now received a letter from the (fictitious?) N. Martin, claiming that I have lost the right to appeal to POPLA as

'the date of the incident (DOI) and the date of your complaint (DOC) is now greater than 29 days which under Schedule 4 of the POFA 2012 now renders the registered keeper of the vehicle liable for the drivers actions. I must also explain that you have also lost the right to appeal to the Parking on Private Land Appeals Service
(POPLA)'.

I am not sure how to respond to this, although I am sure that is not the case? I am under the impression that after receiving the NTK I have 28 days to appeal (which I did), and then they must send me a POPLA code.

Any thoughts on this?

    Email them back to say:

    "Hoi! Trev! Is that the best you can do? You know fine well that any appeal is from the date of your letter (notice to keeper) and not from the date of the of the parking event.

    Stop being an a-hole and either accept my appeal and cancel the PCN, or send a rejection with a POPLA code.

    PS - you are being reported to the BPA for breaching their code of practice.

    PPS - your letter will be used as evidence of your deceptive practices in any court claim that may arise.

    Not seen that before, a new pack of lies penned by the lie that is N. Martin?

    The Protection of Freedoms Act 2012 says absolutely nothing about cut-off times for lodging an appeal, so it's just a Big Fat Hairy Lie.

    Send a copy of the NtK, a copy of your appeal, and a copy of the BFHL to Steve Clark at the BPA. Point out that it's a pack of lies, point out that you are entitled to a PoPLA code, and demand to know how much more of this nonsense ANPR Ltd. will be permitted to get away with before it is expelled from the AOS.

  • Send a letter saying no POPLA code = No keeper liability under POFA, so please yourself, see you in court, good luck finding the driver.

    I finally got a POPLA code from them, and despite their promises to cancel the ticket, I lodged an appeal anyway.

    Of all the PPC that I deal with in my job, these guys really are comically unprofessional.

    Yeah I just found some previous offences by big Trev to not send POPLA codes... I have complained to the BPA using emails in the **NEWBIES thread, and also to the DVLA about the breach of KADOE contract.

    Im just thinking whether I should demand a code and beat them at POPLA, or because they have now breached POFA twice now (late with the NTK, and lack of POPLA) they have no keeper liability so they can't get it off me?

    As long as in the complaint email to the BPA you didn't say you 'got a PCN but then waited for the NTK' (surely not). Just checking! The keeper wouldn't know anything until the letter arrived.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    I've just had the same problem with Anpr ltd, teaken me 4 months and a complaint to the bpa to get a popla code! Just complain to the bpa, I scanned all the letters I had off anpr and attached them to my complaint and get a code a few days later

    It is widely believed Trev must have photos of someone high up at the BPA with a sheep, given the amount of stuff he pulls with nothing ever happening to him.
