ANPR ltd PCN.. Help

In august we parked on a pay & display car park, bought a ticket and left it on the dash. When we came back there was a pcn stuck on the middle of the screen! Couldnt believe it as we'd paid and returned in time although the missus seems to think the ticket had slid so was still on the dash but sideways (would still be readable)..

Anyway, having never had a ticket before I came on here to look for advice and read to wait for a NTK. We finally got a NTK the other week from ANPR ltd demanding £140 and I'd missed the early bird £50 payment. I sent off the templete letter asking for a POPLA code and a copy of my pay & display ticket.

This week I received a letter back from anpr ltd saying Whilst I inform you that the date of incident (DOI) and the date of your complain (DOC) is now greater than 29 days which under Schedule 4 of the protection of freedoms act 2012 now renders the registard keeper of a vehilce liable for the drivers actions. I must also explain that you have also lost the right to appeal to the Parking On Private Land Appeals Service (POPLA) and we ANPR ltd who have satisfied all of the schedule 4 criteria now have the right to recover any under paid parking charges from you the registard keeper.

Thats just one paragraph agmonsgt others telling me how he personally knows the site, has talked to the issuer and seen photographic evidence which weakens any argument etc..

Since I only just got the NTK and they say I have lost my right to appeal to POPLA, what do I send back now?

Any advice/help would be great thanks..

    Doesn't that term just make you giggle, it does me! What an utter prat that Trev is thinking people are daft enough to think it's a bargain to be snapped up!

    Google the sentence - you will find hundreds of other people laughing about Trev and his and his staff's ability to 'know every car park personally'!

    They are so funny - this firm are the joke of the forum they are such liars and their letters such rubbish! But they are also breaking the CoP by not considering an appeal from a keeper and sending a POPLA code. So obviously you complain like the Newbies thread tells you to, for people who don't get a POPLA code. See post #6 of the newbies thread.

    Of course in your complaint email to the BPA you don't talk about the PCN or 'waiting for the NTK'!! You just complain as keeper attaching a copy of what ANPR Ltd sent and say they haven't given you a POPLA code. Do NOT tell the BPA who was driving, of course, they are not on your side but they WILL investigate a lack of POPLA code.

    Thanks for the help. Yes I've read lots about anpr ltd on this forum which has made me feel a lot better!

    What response should I send to anpr now though?

    None.

    Ignore the fact that some village is missing its idiot and channel your energies into complaining to the BPA. Sooner or later this blizzard of complaints about owd Trev will tip the balance and, in the process, tip them out of the BPA, thereby denying them the facility to access keeper details from the DVLA.

    Game over, P45s all round :beer:.

    Or you could write and say you've reported them to the BPA and remind them that a registered keeper can appeal, and that you don't believe for a minute they 'know the car park personally'. Offer them an 'early bird offer' to cancel before they get into trouble with the BPA and say you are sure Trev doesn't need further sanctions!

    Nope not for that. It's merely writing a 3 or 4 line letter (or email if they allow email).

    I've just received some letters today about my pcn from Expedion telling me I have 14 days to pay £210 now before this goes to court, they have included a Northampton county court claim form (I'll try and attach) and a statement from Steven Gerrard (lol) with a pic of the back end of my car!

    I have written to ANPR ltd twice asking for POPLA codes but have had no reply! After searching the forum and seeing this is common practice from anpr I need to complain to the BPA but I'm not sure what I need to say in my complaint?

    Also, Do I reply to this Expedion court threat? Any help would be great..

    Seen this before from ANPR Ltd. Just write an email to Steve Clark, you don't need special wording. Tell him about it and what ANPR Ltd have done, and attach the letters. That's a blank claim form as I am sure you have spotted.

  • Did you complain to the BPA as advised OVER A MONTH AGO?


    Ignore Expedion, which is actually another branch of ANPR. Sending out fake court papers is very dodgy indeed.

    Thanks guys, yes I sent an email to bpa but never heard anything although I may have sent to the wrong email, not the one in the newbies sticky..
