£564 Paid by Debit Card

Hi,


I purchased a Sofa for £564 in October and was supposed to be delivered 10th December, took a day off for the delivery rang the company around lunch time to confirm delivery then informed no delivery today as the Sofa not in stock, I said why did you confirm delivery date if you did not have product in stock.


The company let me down badly and no Sofa came on the due date. They agreed to cancel the order on the 10th as they could not guarantee when it would come and agreed on a refund back to my debit card.


The following day they supposedly sent a return payment to my debit card said would take 3 days to go back on my card, did not arrive. rang on Tuesday, one of the staff said they had changed banks and still be processed.


Rang Wednesday and now told bank was not being changed but Merchants again I queried this. I spoke to of one the senior sales and told Accounts Department in another building with no phone line, and can only communicate via e-mail.


So basically its a week that they have promised me my money back, and as of now still no phone call to confirm my money has been returned.


When I spoke to Sales guy, asked is company in liquidation could not confirm or deny.


Have I lost my money.


Am I allowed to name and shamed company.


I would be grateful for any advice.

  • oh hell. dont they just try it on????? what a shame you didnt do it on a credit card. im sure you will get your money back, go to your bank, i bet they can help you.

    Why would you wait 2 months for delivery of an item if you thought it was already in stock? :huh:

    Send LBA, and follow up the threat contained therein if necessary.
    (based on their agreement to anull contract and refund you)

    Worth giving your card provider a call too, to see if they can help you or otherwise offer advice :)

    I don't see where the OP said that they thought this.

    And I don't see any point in wasting time on sending LBA if simple chargeback is available.

    The delivery took long as follows, 3 weeks wait already stated on their web site due to delivery from China. Then I got stuck on Jury Service between delivery dates (3 weeks), then we arranged delivery for dates around early December.


    At the time of delivery on the 10th, I was not informed that the product was not in stock.


    It is normal practice for a company to inform the customer if it does actually not have the Sofa in its Warehouse. And promised me a delivery on the 10th


    Basically I was lied to, what was the point, I lost a day's pay for nothing.


    Also I called the company again at 4pm, again I am told that refund is being processed, this time the sales guy can now conveniently speak to the Accounts Department, when yesterday it was e-mail only.


    I have spoken to Santander and they are sending me a Chargeback form to complete.

    It may not be that simple, particularly as the OP probably has no evidence to provide the card company of an anulled contract, but a call to the card provider as I suggested will establish if the card company are prepared to assist, and if so, how.

    An LBA will get the ball rolling otherwise.

    When were you given the 10th Dec as a delivery date? When you ordered the product and were aware it was coming from China? Or recently?

    Did you really lose a day's pay? Or did you just book a holiday?
    Quite an expensive sofa if you have to add a days pay to the price.
    But then you presumably knew you were going to have to take a day off work and factored this into the price.

    Looks like it may not be so easy with an anulled contract, compared to having arranged another day off to take delievery of what you originally ordered (but there is a hint it might just still be possible)

    If there is anything you can claim for, you can add that to the LBA
    (You'll be lucky to get a card provider to reimbuse such consequential loss)
  • The date was agreed around sometime in November, I was told that they didn't have product in stock until they did, I had to wait.


    When they received the stock, we couldn't agree a date, because I was selected for Jury Service to start 17th November and that would be for 2 weeks, my luck I had to do 3 weeks.


    Luckily I arranged the 10th, but it seems from the delivery manager, I wasn't booked in and now they could offer next day delivery on a any Sofa I didn't want.
