i have found out that im out of pocket alot more than expected.....
It will be important to bear in mind in a case of actual financial loss that, within reason, you must be able to prove the amount of actual loss...... the special payments department have told to to put any loses down on paper and they will pay these back...
Have you had that in writing ?... but they have also mentioned giving me a consolitary payment and have asked me to come up with a figure of what i would like and they will consider it...
A Consolatory Payment is not dependant on you having suffered a measurable financial loss.....i have tried going about this by looking at other stories regarding this and i have only found 2 1st a woman who went to court and got £100000 for a mistake with her husband pension ( over 10 yr period) 2nd was a guy who IS payments were messed and didnt recieve any payment for 3 months he was awarded £400 plus the benefit back dated....
Possibly in the 1st case, the payment of £100,000 was made because the lady had suffered not only the financial loss, but severe distress. and her physical or mental health had deteriorated significantly as a direct result. Medical evidence would be required to support that claim.
In the 2nd case, again, it's entirely possible that because of no payment being received for 3 months, the man clearly suffered financial losses that he could document....so what do i do?
Calculate any financial losses, distress and misery it's caused and put in a figure so they can consider your claim. But don't expect to be in a much better financial position than if the maladministration hadn't occurred.
In other words, don't be greedy.

thank you, yes i do have this in writing, my actual loses accumulate to £2000. and i have all the paperwork to prove this.
did i mention that this has been going on for 4 yrs nearly 5. so i feel there has been substantial distress, also my wifes health has deteriorated during this time both physically and mentally!
as far as the consolitary payment i really do not know how to act on this................i dont want to be greedy but how can i justify what i ask for other than using previous examples of these sort of complaints0
