clarification of genuine hardship cases

I too am dealing with a Hostile and Aggressive Barclay's bank. I originally claimed my bank charges back through the financial ombudsman but then the pending court case happened.
So I read about and pursued furthering my claim based on financial hardship. The financial ombudsman referred it back to Barclay's as they said it was a fresh claim...which it wasn't. Barclay's have told me today that they will not deal with it but they will give me debt advice which is not much help to me as if it wasn't for their charges I would not be in this situation in the 1st place!
So today I have had a letter from a debt agency telling me to pay everything or else.
I am really at the end of my tether over this. What can I do ?0 -
I think we need clarification on exactly what fo and banks mean by dealing with hardship cases,as it seems that it is left to each bank to interpret it to suit them,has anyone been paid out under hardship? if so which banks? please let me know as i would like to see how the diffrent attitudes to this vary from bank to bank0

The letter illustrates that no-one should expect to get bank charges refunded automatically. I think the fortunate ones are those who got their claims settled prior to the decision to go to court by the banks. I cannot imagine that the case will totally go against the banks, I would imagine that they will have to refund a proportion of the charges levied, but not the whole amounts.
Not sure if there is anything more that can be done before the results of the test case are available.0 -
hi novelli i have been following your story for some time as i am in exactly the same situation although my problem is lloyds. been to ombudsman waited eight weeks, told they had been in touch with bank waited another eight weeks and then yesterday told in a phone callwe dont pay out on hardship.I am so fed up with this why has it taken 8 weeks for them to tell me how to deal with my debt,i know already how to sort my problems i just need my money to do it . A lot of people have been given false hope,I was told when i contacted the ceo yes we do deal with hardship cases what they fail to tell you is that they dont pay out just advice. Well i am going back to ombudsman even though it seems futile but i am not going to sit around twiddling my thumbs as gone to far to give up.I wish martin could let us know where people stand on this issue as a lot of people are facing a not so happy christmas me included.0

Spoke to the ombudsman yesterday and complained about this very thing. They told me that my case is still being dealt with by them under the act. What the outcome will be I don't know. Probably to give me debt advice even though I wouldn't be in this situation if it wasn't for the bank charges and the snowball effect.
I will keep you all updated as to what the FOS say.0 -

i sent my list of charges to the halifax yesterday, stating that i was a being pulled down into a genuine hardship case... i will keep you up to date with the full sp as soon as i hear from them.... i aint got no faith in them yet, hope they prove me wrong;)Corduroy pillows are making headlines! I sent a snotty letter asking why get us all excited and build our hopes up thinking they may consider us being in hardship if all they were gonna do is say no anyway...:rolleyes2
