clarification of genuine hardship cases

Im very aware their is a wiever given to banks while this test case is ongoing but i also read that this does not cover certain cases an they should still be delt with now. These include hardship an any fees taken from unemployment benefit placed into my account which has happened to me.
Thro sicknes i have not worked for 7 years and have sufferd in this time banking fees.
My 1st question.... is it worth proceeding with a claim now under the circimstances all fees were taken from my benefit.
2nd question.. can i also claim under hardhship clause due to me still been unemployed.
3rd question how would i prove to the bank that i was unemployed during this period.
4th question ..would i get much joy having expressed the above to my bank and asking them to tally up my fees an simply return the amount without having to make a claim an bypass the £10 fee for getting last 6yrs fees history from them. i ask this because even finding the £10 at this moment in time is hard.
i would like to mention also Im with the Northern rock (dont laugh) I wanting to claim as soon as possible in case they simply dont excist come the final judgement of case...

It makes no difference that the fees were taken from benefits. Your position is exactly the same as anyone else's.
I certainly wouldn't worry about Northern Rock. Haven't you heard, the good old taxpayer is propping it up.0 -
It makes absolutely no difference if you are on benefits. The advice that bank charges infringe the Social Security Administration Act is 100% WRONG.0

Hmm... so based on that what would your advice be? I'm thinking that replying to the above letter and asking them just to keep my case in the queue for when the test case stuff is fully sorted. May be a better idea?0
