clarification of genuine hardship cases

I recently started the claim process with A&L and requested they deal now rather than wait until the Test Case has ended under the hardship ruling. I have just received a letter from them asking me to complete a full Income & Expenditure form and saying they will deal with my request after the test case result is known! I thought the FSA had ruled they had to deal now rather than wait??? I am in severe financial hardship and need to move this on (I actually want to clear my overdrafts with them with the charges, so they're not actually giving it me back). Can anyone give me further advice about my next move????0 -

I am in the process of writing the first letter to the bank, if I am in receipt of Working Tax credit and Child credits, can I claim under the 'Income based benefits' on the letter to the bank??0 -
I'm not sure what your asking here. Is it whether you can claim back your charges as you think they are excessive? Or is it that you don't think you should have paid them due to recieving benefits?

If it's the latter then no. Your income has nothing to do with reclaiming bank charges.If you can't think of anything good to say, then you're better off not saying anything0 -
Hello all I need some advice please.
I understand most of the ins and outs of the current court case with the FSA and the banks. But I read on a few
sites that if I am in financial difficulty the bank still has to sort my complaint out, failing that, I can wrote to
the FSA who may look at it.
The bank owe me just over £1000. I am unemployed at the momentand the bank are chasing me for arrears in loans that
I have had. I f I had the money they owed me, I could then pay them the money I owe them and still have a couple of
hundred quid left over.
At the moment they are threatening debt collectors.

A friend of mine is living on Incapacity Benefit of approximately £103 per fortnight. Is his bank wrong to charge him £30 when a direct debit put him over his limit by £6?

Please please can people on MSE stop perpetuating this nonsense that banks cannot take charges out of benefit. Yes they can and do. Income from benefits is treated exactly the same as income from any other source.
I honestly believe this is one urban myth that MSE is responsible for. I know people say it with the best intentions but it simply isn't true.0 -

Last summer i just before the OFT and the banks started the court case i contacted my bank nationwide to claim my bank charges back. They replied back saying they have been suspended and would contact me when its finished. After nearly a year i am none the wiser to wether or not if i am able to get th money back.
I would like to know if i can continue my claim or have to wait till the court case has finished. And if i can claim any new charges. At this point in time i am suffering from financial problems and have barely got enough to pay debits etc...
Getting these charges bank would certainly help ease the financial pressure.0
