nickmack is right.
Where did this crazy idea in respect of it being illegal to charge people on benefits? I know the statutory provision that is often quoted but it is totally misreading it to suggest that those on benefits are immune from bank charges.0 -
i heard somewhere that if you are suffering financial hardship you can request the bank to pay the charges back to you,is this correct im not in financial hardship but they don't know that do they :beer:0

Hi,
Can anyone please help. I have gone down the financial hardship route with the FOS and Abbey. Despite proving i am 10k in debt they have put my case on hold because none of the debt is with the Abbey. Does anyone have advice. My total amount of reclaiming with the abbey comes in just under 5K

i originally filed my complaint against my bank charges in march 2007 and to cut a long story short they suspended the claim due to the test case but every charge they have taken has been from my income support and i told them this and i was still waiting so a couple of weeks ago i contacted the financial ombudsman and they gave 8 weeks for them to sort out my complaint but today i have recieved a letter from my bank which states that
the legislation has been misinterpreted as where the law refers to "charge" this is meant "to assign an asset" rather than "to incur a fee" and they say "this does not mean we cannot charge fees in respect of the products and services we offer you as your banker"
they have also sent me a budget planner and told me that if i dont reply in eight weeks they will close the file. what do i do now??? i feel as though i am going round in circles:kisses:0 -
I have read that you can still try and claim back your bank charges if you are facing financial hardship as the banks are meant to help you.
Does anyone know how I go about this?
Do I write to the bank first, and then try the Ombudsman if their response isnt satisfactory, or do I go straight to the Ombudsman?
Either way, what do I say?
Were in a lot of money trouble at the minute, all very unexpected.

The law doesnt state that you cannot incue a bank charge whilst on benefits, it means nobody can assign a charge to the benefit before it gets to you. Once it hits your bank account its classed like any other funds.0

Unfortunately because people are still quoting this Social Security Act 1992 or whatever it is people are still being convinced that bank charges cannot be taken from benefits.0
