just wanned 2 let you all know that banks MUST filter cases of genuine hardship & still process them within normal timescales xxx i put my circumstances (financial difficulties ) in writing to halifax & i know at the moment it is being worked on by a special team xxx im watching the mailbox everyday xxx i wonder what the outcome will be or if its just another stalling tactic xxx if any1 else has done this already i wud be really interested to hear your story xxx i will keep u posted as to mine xxx;)

I m in the same position with HSBC, BUT only after i got FOS involved, BUT suprise suprise HSBC are now a week over the 8 week deadline that FOS set them to respond and all i get when i email to ask is its beuing dealt with by relevant department who will be on contact in due course!!!
NOT GOOD ENOUGH!!!
But as a consumer what are we supposed to do. The banks are breaching th9is waiver left right and centre, but they just get away with it!!!
We KNOW that they MUST stick to certain rules and regs as part of the waiver, but the fact is they are not doing so!!!!!!!!!!!!!!!!!0 -

sadly its the same old story of the banks riding roughshot over us all!!!!!!!!!! they breach the waiver, break the law, make up their own rules as they go along but just get away with it!!!!!!!!!!!!!!!!!!!!!!
Fos seem too busy to deal with it in a timly manner.0 -

just recieved a reply from the halifax after i sent them a letter telling them that we were in financial difficulties and we needed the money they owed us for unfair bank charges totaling £3881.00
they have just sent one back saying they are not going to deal with it until after the test hearing and won't correspond anymore with us or any other party:mad: :mad: :mad:
what do we do now continue with court proceedings or ring financial ombusman or wait for the test hearing
we need this money as we have debts to pay
can't wait to here what you advice

"Can I make a court claim for a refund during the test case?
Yes, but we will apply to the court to put your case on hold while the test case is running. This is because the issues being raised in customer complaints on unauthorised overdraft charges are being considered in the test case."
"Can I complain to the Financial Ombudsman Service about my bank charges?
The Financial Ombudsman Service (FOS) has decided not to review complaints while the test case is running. If you do complain to FOS, they will respond to you confirming their position directly."0 -
should we still proceed with taking Halifax to court so then the six years charges start from then or just leave it until the case has been heard. will Halifax be able to stop the court date going ahead or will the court just not deal with it. i need help on this as I'm0
