Do the ANPR cameras require planning permission ?
Although my ticket has been cancelled this bunch of rogues have annoyed me so I think it's only fair that I cause them some annoyance too.
It concerns me that older or vunerable people will pay these "invoices" due to the threats of debt collectors and court proceedings.
Any advice, legal or otherwise, would be greatly appreciated.

I've had a trawl through the planning applications on the local council site and can find no mention of any cameras or parking signs in any of their applications so I've sent an email to the planning enforcement officer.0

I was polite but VERY firm and I spoke loudly enough for people to stop what they were doing and turn and watch what was going on.
My wife hates it when I do that.You never know how far you can go until you go too far.0 -
After a request I made 5 MONTHS ago, I have finally received a reply from the local Council with regards to the planning permission for this ANPR system
Dear Mr ,
I write in response to your e-mail below and apologise for the delay in responding.
I can confirm that the matter you raised was investigated under planning enforcement case reference 15/5002. As part of the investigation a site visit was duly conducted to assess the situation. Following this visit the relevant planning legislation was researched which confirmed that as the cctv was not installed on a building, but a lighting pole within the car park, that it could not be considered permitted development and therefore, the cctv as erected is considered unlawful development.
The National Planning Policy Framework (NPPF) states, under paragraph 207 - Enforcement, the following:
'Effective enforcement is important as a means of maintaining public confidence in the planning system. Enforcement action is discretionary, and local planning authorities should act proportionately in responding to suspected breaches of planning control. Local planning authorities should consider publishing a local enforcement plan to manage enforcement proactively, in a way that is appropriate to their area. This should set out how they will monitor the implementation of planning permissions, investigate alleged cases of unauthorised development and take action where it is appropriate to do so.'
The Council acknowledges that the installation of the cctv is considered to be unlawful development, however following observations on site, it is further considered that the cctv and metal case housing it is has limited visual impact upon its surroundings and the development is deemed to be de-minimus. It does not cause any significant harm to the area in question and is a form of development that is to be is expected in this type of location. Bearing in mind the advice contained within the NPPF, it is the opinion of officers that it is not appropriate to pursue any form of formal planning enforcement action in this regard, as it is not considered to be expedient or in the wider public interest. The case has therefore been closed with no further action intended.
So, basically, they admit it's an unlawful development they're going to do !!!!!! all about it !
Any advice on how to proceed with this would be appreciated, I want to cause G24 as many problems as I can even though I got my fine cancelled0
