good obviation, it was my mother-in-law that was at home looking after my 2 little kids so she couldn't leave the house to pick it up.
note. i did not say at any point it was ok to deliver to a neighbour.
I've had the same situation occur before and after repeated attempts with regular customer services, I emailed the CEO's email address quoting:
The consumer contracts regulations state:
"The goods remain at the trader’s risk until they come into the physical possession of— (a)the consumer, or
(b)a person identified by the consumer to take possession of the goods."
It was the Distance Selling Regulations at the time and I got a full refund. It's up to GAME to deal with DPD, it's nothing to do with you once you've established that there's no way of getting your parcel from them.0 -

Well, it was a last resort for me - there's only so many times you can email customer services! It might be worth mentioning to customer services that you'd rather not have to pass it on to the CEO.0 -
I would suggest that you contact Game again and point out their own terms and conditions to them.Special Deliveries
Orders shipped via courier require the customer's signature upon delivery and cannot be released by the driver without this.0 -
thanks everyone, i stated a few regulations to the game rep and hes currently talking to his manager then ringing me back in 10 minutes.0

the balls moving, GAME is talking to the carrier to find out what happened with the delivery.shaun_from_Africa wrote: »I would suggest that you contact Game again and point out their own terms and conditions to them.

they've had to ring me back 3-4 times now0 -

still leaves the fact that the other console is "somewhere".
ive said to GAME and DPD if they wish to take legal action against my neighbours they will have my full support.
