hi, i had a delivery from GAME.co.uk via DPD yesterday, the package got delivered and signed for at 4pm by my neighbour.
the package was a £300 PlayStation 4.
(also there was someone in my house to sign for it, knowing a package was going to be delivered, there was no knock. all she heard was the "attempted delivery" letter saying its next door being posted)
i arrived home at 6pm and went over to collect it.
some kid was there (he didn't live there) he had a look around for it, as the 18 year old kid who lives there (who signed for it) was out.
he couldnt find it.
the kid who lives there came over after saying he cant find it (making excuses). he even asked how big was the box? he should of known as he signed for it 2 hours ago!
they are saying now its been lost/stolen so i rang the police. they searched there house for it but didnt find it.
police advised me to try and settle it out without the courts if i can.
ive contacted GAME. there punch line is :
"I'm afraid at this point, as the order has been confirmed as delivered and received by your neighbour, at which point it has then gone missing, this is now classed as theft and a police issue and is not something we cover for."
i rang DPD, they told me to ring GAME to set up a investigation for the two company's to talk.
but GAME isnt playing ball, they say its out of there hands because its been stolen after its been signed for, (but not my me/my address!)
can anyone advise me what to do? £300 is a lot to loose.
ive even took the day off work today due to feeling so bad over the situation.
(p.s. im not the best at complaining & kicking up a fuss, im trying my best though :-) )
any help will be greatly appreciated
Thanks!

Did you have anything in the delivery notes to authorise it to be left with a neighbour or a safe place? If not then it hasn't been delivered.
Game/DPD may say "But it was delivered to your neighbour!". YOU say "Maybe. But the contract was for it to be delivered to my address. You have failed to do so - send me another one or give me a full refund".
The responsibility for finding out what happened to the original is Game's, not yours.0 -
The consumer contracts regulations state:
"The goods remain at the trader’s risk until they come into the physical possession of— (a)the consumer, or
(b)a person identified by the consumer to take possession of the goods."
The items have never been delivered to you, locating them is Games problem.
How did you pay? If Game refuse to refund then it may be worth trying a chargeback or section 75 claim.0 -

However, I do agree it is Game's responsibility to locate the whereabouts of what is still their property and they have failed to deliver it into the hands of the consumer who purchased it.
It'll be interesting to see where this actually leads...0 -
Our of interest, if someone was at home at 4pm and got the delivery card straight away why didn't they go and collect it at 4 instead of waiting for you to get it at 6?0

Thank you for your replies. Ill ring game again in a moment with your words as ammunition. :-)

good obviation, it was my mother-in-law that was at home looking after my 2 little kids so she couldn't leave the house to pick it up.
note. i did not say at any point it was ok to deliver to a neighbour.0 -

You didn't answer that questionThank you for your replies. Ill ring game again in a moment with your words as ammunition. :-)
If the answer to the question was Yes then your powder may not be as dry as you think.0 -
