None of the documentation I've read mentions about Credit Cards. If you are reclaiming credit card charges, I would continue.

I think so too. By totally ignoring me since feb (apart from computer-generated letters etc), Abbey have delayed me even getting my charges information from them. Will they be held accountable for disregarding the 40 day ruling? I doubt it. By doing this, they have effectively prevented me from even starting a claim!!!
On top of that, they have "lost" money I left in my account when I moved to France 18 months ago, they even lost my change of address form!!

Yes, it's funny how banks only show NHS levels of incompetence when they've nothing financial to gain from it.0 -
As consumers should we not be involved with high court ruling. It is our money that they are taking. The consumers groups have just been left out in the dark and they are the ones fighting our corner. Maybe we should all write to the high court and put our case forward. They may listain to the people who this affects then.0

Are others out there as completely sickened by this as I am? Its not the test case that annoys me (that was bound to come at some stage) but the way that the in the interim the banks seem to have won....we can do nothing, everything is on hold FSA waivers, FOS not taking new complaints and putting existing ones on hold, banks able to apply to courts for a stay pending outcome etc etc meanwhile the banks are able to keep on making these charges. This seems so unfair and it feels like us consumers are being screwed again. Is there nothing that we can do about any of this?0

I JUST SPOKE TO A LADY AT THE FOS, AND THIS DOES NOT AFFECT UNFAIR CREDIT CARD PENALTY CHARGE COMPLAINTS SUBMITTED TO THEM IN ANY WAY.
Erm, I know this is really selfish, but maybe this means they'll be able to deal with my credit card claims quicker!

Ive just spoken to my local county court where my case is being heard, and have been told to their knowledge my case is still being heard0

Good Luck with your cc claim! Hope the ombudsman can at least sort out the Abbey re. my 'lost' money etc. Will have to wait for the charges though!

Whilst this is great news for the future.... can I just say a big Argh!!:mad: for all of us who have cases pending!
I went the FO route with my Lloyds TSB claim (£1200) which I gather will now be on hold...and the court route for my Natwest Claim (£4000) the AQ fee clearing just yesterday!!
Does anyone know when we can expect to hear the outcome? Are we talking weeks or months?
Btw -I understand that any offers made by the banks before the announcemnt of this case must be honoured (BBC News - Business)0 -
Spoke to some guy at FOS who said everything is stoped now and hopefully the case in high court will come to an answer/be heard in 1-2 years??????
So it looks like we are all well and truly shafted...........
