The FOS should have continued with claims already in their system.
They have rewarded banks for their delaying tactics.0 -

I'm getting really frustrated over this - does anyone know if the banks are still allowed to levy new charges while the test case is taking place???0

oh my god. just got in from work and read whats happened.
really unsure which way this could go. the law is the law but the banks will probably find some way to get out of it.
i accepted an offer from halifax via fos nearly a fortnight ago and have had confirmation from fos that halifax have been notified that i have accepted. i think i should receive my refund as they've offered and i've signed. and they did say that it was as a goodwill gesture. not an admission.
are we ok still claiming for credit cards fees as the oft have already lowered their charges? if so will we be only to claim the difference of £12? how far can we take it? i've just put in a claim for full amount plus stat interest. i was claiming stat interest as they were charging a higher rate of interest on my charges. not sure if they will get back to me and realistically how far can i push them?
any thoughts anyone?0 -

My claim has been ongoing against First Direct since January, in May I heard that the Court would not hear my case until the end of August!
My claim was for an amount from 6 years ago, when I had breast cancer and was unable to sort out my account properly. I wrote to the bank before my treatment informing them of the situation. However they still took my sick pay and benefit, when I was too ill to deal with my Finances.
I telephoned them to complain and was sneared at; my husband wrote to them accusing them of deliberately compounding charges so they could get the most money out of me, because I couldn't defend myself. His letter was met with denial, but they did pay some of it back.
Could I still proceed with my claim on the basis that they took my sick pay and benefits?0 -
could someone please tell me if this test case stops ALL ongoing cases? as i understand the case, it is only dealing with unauthorised overdraft fees. if this is the case, what about all the people on here claiming returned DD and unpaid cheque fees? surely these are not covered by this case and should, therefore, continue as planned.
i already have a case which is going through the court. i have got a letter from the court saying that HSBC have until the end of august to pay up or send in a defence. does this still stand as the end of the letter says the case is stayed until 7/09/07 if the bank does not enter a defence. does this mean that i will still be awarded by default if they don't?
reading the amount of cases on here, it seems that we are in the same boat as most. i mean, the 1st dip under the black line may be our fault but, due to the high charges, we found it very hard to get back out.0 -
main questions so far:
1. Does the waiver apply ONLY to overdraft charges or also to credit card charges, bounced cheques, failed direct debits, etc?
2. Why has FSA applied a waiver on current cases, but did not apply similar waiver to current bank charges?
other questions seem to have been already answered by OFT FAQ (see http://www.oft.gov.uk/advice_and_resources/resource_base/market-studies/personal2) and by FOS FAQ (http://www.financial-ombudsman.org.uk/faq/bank-charges.html).
Somehow i feel the banks will twist this in their favour, may be a compromise of some sort... I just cannot see the government and The Lords allowing a payout of 10 billion, its not going to happen.0 -
I hope the Banks have remembered to put any future charges on hold.
Surely they have clearly admitted they don't know if the charges are legal until the courts decision is known so they couldn't possibly continue to levy the charges from now on.
