County court judgment against the wife over a year old

  • Right so the situation so far, so after our set aside hearing we received the court papers on the 12/02/2015. Now I couldn't remember exactly what the judge agreed to but I knew it was force POPLA decision and for parkingEye to pay the cost of the set aside. What actually the judge agreed to was force popla and the claimants to pay my wife the £155 by the 16/02/15, not after the outcome of a POPLA appeal ! So yesterday she received a cheque from parkingEye for £155 !!!
    So fantastic news , but there has been no mention of the POPLA code , I wrote to them straight after the verdict demanding this.
    So do I now just let sleeping dogs lie , or shall I write to them demanding a POPLA code, or ask for them to drop everything? Obviously for ease we would prefer the latter . I await your opinion's . Thanks
  • hi I'm bouncing this as i have had no replies, plus Ive never heard of parking eye paying out before a POPLA decision or a defense hearing!

  • Nope they have "as a gesture of good will they have extended their discount period for another 14 days" and they have supplied the popla code! So better start typing again !

    Remember you have 28 days for POPLA+ another 28 for additional evidence, mre, regardless of 'failed to take advantage of our humungous discount offer' bumf+added threats, which will doubtless come.

    An appeal form can be requested from the parking operator whom issued the Parking Charge Notice, POPLA are unable to issue appeal forms directly.
    Submitting your evidence

    Include any photographs or documents that you want the Assessor to consider.
    You should try and submit everything at the same time as you appeal, whether online or by post. If you do send anything separately, it must be before the decision is made.
    You may submit additional evidence via the website up to 28 days after submitting your appeal online. You may only submit evidence online if you have appealed via the website's “Submit an appeal online” link found the left hand navigation pane. Click here to submit additional evidence online.
    If you have appeal by another method please submit evidence the same way. Please make sure that you mark all pages or photographs of your submission clearly with your verification code.
    If additional evidence arrives shortly before the Assessor is due to consider your case, the matter may have to be adjourned. If it arrives after the decision is made, it will be too late to be considered.

  • thanks ampersand, as this was going to go to court, ive written out a very thorough defence. i will edit this slightly so its more readable and submit that to POPLA along with a index of all the evidence i will be supplying. If POPLA still agrees that £100 is not a genuine pre estimate of loss then im very hopeful.ill let you know how it goes!

  • i will look into them both, but after a quick look it mostly appears to be what ive already said, it might be handy to have a recognised motoring body disagree with the way the system works, i'll look into it!

    So after 6 months of legal crap, stress and waiting we finally have our results back from popla. Appeal granted reasons being "The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were. Accordingly I have no option but to allow the appeal. " ParkingEye, the scumbags didn't even protest, but happily refusing not to drop their claim before it went to popla. So me and the wife want to say a big thank you to everyone on here that has helped us through this stressful time, especially Parking Prankster. So if anyone would like a copy of our popla appeal, or a copy of our set aside appeal (which the judge was very happy to set aside, referto popla AND refund our costs before the popla results ) just ask!
