JSA HELP (Really Need Help)

Hiya people am in a lot of problems, I finished uni and got my self a job in a call center. I stopped my jsa claim and decided to work. All was good during training and work for a few weeks (4 weeks working so far) but all off a sudden my voice had been effected 3 months prior to starting work. (Wasnt as bad as it is now, I can barely speak and I am constantly clearing my throat). This is causing me problems to speak which is very hard for me down the phone.
It seems I will need to be undergoing a ENT camera down my nose and throat (Doctor stated this) until my problem is resolved. It seems like acid reflux which is effecting my voice box and damaging it.
Since I am not ill enough for esa (I dont want esa either as I want another job not using my voice or until am recovered within a few months. But I would like to claim jsa again until that happens without a sanction).
This current job at the call center does demand a working voice which I dont have and no idea how long it will be down as its been 3 months and not recovered and has gone worse. If I get a letter from my GP stating the fact I cant continue with this JOB, and proof that I will be under going a ENT camera down my nose and throat to identify my problem, will the decision maker from JSA appeals be in my favour? If I quit my job based on my problem?
Thank you so much guys for any help, I am new here, forgive me if I have made mistakes in this forum.

Are you getting sick pay? I believe the course of action JSA expect would be for you to stay on sick pay if your doctor will sign you off and job hunt from there - unless your employer either finds you a role you can do or lets you go.But a banker, engaged at enormous expense,Had the whole of their cash in his care.

I am not getting sick pay, i started work 4 weeks ago. My problem with my throat has gone worse over the 3 months and this issue began before i even started work. I cant speak at all.
I can no longer use my voice which is why i cant continue with my call center job, my voice is badly effected. I did state its a temp job and I DONT WANT ESA and I AM NOT ON SICK PAY (I MENTIONED THIS IN MY POST) sorry not being rude just stating the facts. I CANT GET SICK PAY either as its a TEMP JOB.
I want another job i.e where i dont need to use my voice until I see a ENT doctor for a throat and nose check up or I would like to go back on JSA without a sanction and look for other work until i recover. I can get doctor letters i.e proof that i cant do the type of work am currently in.
Thank you
Sorry if u think am being rude.0 -
I would just like to go back on JSA until my problem with my throat is resolved from the ENT doctor. Can i do this if i have a letter from a doctor and a ENT doctor? And without a sanction from JSA.
Thank you0 -
Afraid OP you will get a sanction if you sign back on jsa, even though yyou have a reason. Not more than i can suggest, have you rang the jobcentre for advice? That is wll i can think of.0

Sorry mate, what does OP mean. Am new to this forum. Even though I have proof from my GP and a ENT doctor stating I cant continue with my current job? Surely with proof they cant sanction me? Well Job Centre state it will have to go a decision maker.
Has any one ever left a job because of a medical condition? And signed back on without any sanction. Surely if a persons health on a certain job is restricting them to do a job there must be a solution to this? With proof from a doctor surely there should be some solution from Job Center?
Does anyone have any experience in a situation like mine? Or leaving a job based on a medical situation? And signing back on jsa without a sanction?
I did hear that a decision maker looks at proof inorder to see if the person left based on a valid reason. And if there is NO VALID reason and the person left just because he didnt like the job he will surely be sanctioned. But based on medical grounds am not SURE.
Just want to know has any one left based on medical grounds and with the support of a doctor?0 -

OP (original poster) you would get sanctioned, an a decision maker would take weeks to make a decision leaving you without money for a while.0 -
Even with a vaild reason? Job centre told me if i have proof from my GP that my voice is effecting me to not do my job, the decision maker looks at the proof. Whereas just leaving a job because a person does not like it will be a sanction. I am not LEAVING A JOB BECAUSE I DONT LIKE IT. I want to leave because I cant speak and without a voice how can I continue to do a job which requires a voice?
And the above is slightly incorrect. People who leave a job will get JSA once re-applied (BUT ONLY UNTIL THE DECISION MAKER STARTS QUESTIONING WHY THE PERSON LEFT A JOB) but in order to be stay on JSA WILL BE DEPENDENT ON WHY THE PERSON LEFT I.E WITHOUT A VAILD REASON, AND EVENTUALLY THE DECISION MAKER WILL QUESTION YOU WHY YOU LEFT YOUR JOB, depending on the reason. If i left my job sayin I DONT LIKE IT yes i will be sanctioned.
BUT I NEED ADVICE BASED ON MEDICAL GROUNDS.

Options
1) Claim JSA. As you have said a Decision Maker will make the ultimate call but Guidance suggests your situation would come under 'reason'.
https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/373189/dmgch34.pdf
Read in particular 34313.
As you know your JSA may still be stopped until a decision is made.
2) Claim ESA. There is no sanction for this but you will need a fit note.
By the time they get round to medically assessing you hopefully you will be better. ESA is for those who are also sick short term.
3) Claim SSP (will check but think you are still entitled even after such a short time) Yes, you are entitled.
https://www.gov.uk/statutory-sick-pay/eligibility
4) Ask the employer to give you notice as you are not 'fit for the job' - no possibility of sanction then.0 -
There is no need to write in capitals. I can read it fine without them.
The advice given is correct. If you do leave the job with letters from your doctor, they will sanction you. You can then appeal this, where it will go to a decision maker who will make it a decision. From being sanctioned to a decision being made in your favour can take weeks / months though. Not always but it took someone i knew around 4 months to get it sorted.
In that same amount of time, it's possible your acid reflux will be treated with medication allowing you to continue your job.All your base are belong to us.0 -

IMO you are asking the Job Centre the wrong question - "What happens if I leave?"
They don't like people volunteering to leave jobs. Why do you want to jump before you're pushed?
Surely you've got to be saying you DON'T want to leave, but you've been let go because of your voice.
I doubt they ask that at all much if it's a temp job. It was temporary. Temporary jobs finish abruptly all the time. Company doesn't want you any more, end of story.0
