Dispute the payment, problem solved.
You've tried to deal with the seller and been ignored despite the law being there to protect you, and ebay/paypal have stiffed you too.
If the bank try to wriggle demand a S75 refund (they have to fund that).

Your rights under Section 75
Under Section 75 of the Consumer Credit Act, the credit card company is jointly and severally liable for any breach of contract or misrepresentation by the company.
This means it shares equal responsibility with the retailer or trader for the goods or service supplied, allowing you to also put your claim to the credit card company.
You don't have to reach a stalemate with the retailer or trader before you can contact your credit card provider - you can make a claim to both the retailer and credit card provider simultaneously.
This right is particularly useful if the retailer or trader has gone bust, or it doesn't respond to your letters or phone calls.

Get in touch with Citizen's Advice or Trading Standards to help with a Section 75 claim or advise what else you can do.
If you struggle with that try a newspaper to help, one of the financial help columns should get a result and are likely to pick up your story..0 -
Thanks for all of your help so far but to complicate things further, when eBay assured me that seeing as the seller had refused the return they would be issuing me with a full refund without returning.
I am in very bad health and do need to have a mobility scooter.
So I have bought a new one. The dealer allowed me £200 in part exchange for the scooter in question and thus leaving me £248 out of pocket.0 -
I looked at the manufacturers website and they say something like -this is not suitable for people needing a traditional mobility scooter.
It's confusing isn't it, because it's like they are calling it a mobility scooter then saying it's not one really.
The seller seems quite aggressive. He's put several replies to negative feedback where he accuses the buyers of being competitor businesses and says he has reported them to ebay for slander.0 -

Oh. Well you'll have to just have another go with Ebay. You can probably still follow all the other channels but I think your credit card company could possibly want to see the faulty item.
So, at this stage, it may be annoying, but keep pestering Ebay as best as you can. Message them and if you go to Live chat say you have spoken before and wish to try a supervisor or higher..0 -
Take ebay to court for the money they promised, but then didn't deliver.
