Dealer asked for new logbook and I bought the car before he received it

I dont think the garage got the previous owner to apply for a V5, i think the garage filled out the V62 form and sent it.
When I asked when I could expect to recive it, he told me this could take about 10 days (if waiting on the duplicate) or only a couple of days (if its with the DVLA)
From the notes on the form V62:
'You should receive the V5C within:
Two weeks if you are already recorded as the registered keeper, or
Four weeks if there has been a change of keeper.
However, if you do not receive it in this time, please allow six weeks before contacting us.'
As there has been a change of keeper, it can take longer.

I'm aware it can take up to six weeks, as the garage filled out the form and not the previous owner.
i'm tempted to send a V62 form myself, just in case the garage didn't do it (the trader said it was done, but there is no proof?)
Though I don't want to end up with 2 new logbooks for 1 vehicle and complicate things...
On the other hand, I wouldn't like to wait for 4 weeks and then find out no V62 form was sent to the DVLA and wait for another 6 weeks!0 -
Your complicating matters.
Odds on that the vehicle didn't come with a V5C when the dealer acquired it, probably at auction so the garage applied for one.
The point here is that your becoming impatient and need to obtain one the quickest rout, your going to end up in confusing the DVLA with another V5C request and kick in their fraud prevention measures, if the garage has sent one then you send one, most likely what will happen, is that it will get delayed whilst the find out why 2 different people want to register the same car, at 2 different addresses under 2 different names and alarm bells will ring out on their end and probably end albeit one is a garage and one is a private individual and they will be forced to write the previous registered keeper, and if they fail to respond then there are other measures they can impose such as a VIC check.
The garage was in the wrong here completely knowingly selling you a car with a v5c not present could impose all sorts of issues. Don't go complicating it further, they have UPTO 6 weeks in order to provide a new v5c, if after that date another request FOC has to be sent in and the 6 week timer starts again.
Personally I wouldn't have bought it, alternatively you could call the selling garage and state its not taxed you cant tax it without v5c and either you would like to swap it out for another one of their cars that HAS a V5C or have your money back to go elsewhere.0 -

I called the DVLA yesterday and explained the situation, and asked if I should send a V62 myself. The lady said it would take less time to get the new logbook with my name on it if I applied for one.
Though I'd rather wait (like you said) for a few weeks and see if the garage receives it (there might not be my name on it, but at least I'll be able to tax and drive the car if I get the number?). Plus, this option might take less time to get the V5 number as the garage already sent the V62 form (if they really did).
I'm not in a rush, so I'm just gonna wait and see.
As for the tax, I rang the seller and told him I was unable to tax the car, his answer was: ''it's still taxed (until march 15) until the DVLA update the RK's name''
Basically I should pretend I'm the previous owner..! which I know is rubbish0 -
Pretty much the worst thing you could do would be to pretend you are the previous owner.
If you need to use the car then I'd go to the Post Office, fill out a V62, pay the vehicle excise duty, keep the receipt with you and the rest will eventually work its way out. I'd try to get the fee back from the garage as well.
If you don't need to use it and can keep it off-road then your decision might be different.0 -

dealer sends v62 off a full week prior to your purchase, this is now probably in in the DVLA sorting office waiting to be dealt with, they complete that in the next week and by 1st november for e.g they receive a new v5c and you can get the greenslip then tax it they send the v5c off for your details to be applied.
how will this be quicker with you applying for the v5c now and being placed behind that v5c and waiting upto 6weeks?0 -

It isn't a case of being quicker. The OP has a car that he cannot legally drive. The only way that he can make it legal, that I can think of, is to go to the post office, pay the VED, fill out the V62 and pay the fee for a new V5.0 -

Exactly; even if it comes back to the garage, at least I'll be able to tax the car because I'll have the green slip while waiting for the DVLA to register me as the keeper.
Though I dont think this will come back before 1st of november - from what I know, the DVLA have to contact the previous owner first, and this can take up to 4 weeks if this one doesn't reply. Then wait another 2 weeks to transfer the RK's name and send new logbook. So id say more like a month from now..0 -
I just got a call from the garage this morning and they received the logbook!!
I asked if it was the duplicate (they sent a V62 form just in case the original didnt turn up) and the dealer said it was the original one - which is probably the case as the V62 form was sent only a week ago, so they wouldn't have received a new logbook by now (takes at least 4 weeks).
This is good news (turned up quite quick at the end) but I still find it very weird the car wasn't sold with a V5 in the first place. I asked the dealer where it was, and he said he didn't know.
Now the garage can either send the V5 to me, or I could come and pick it up. I said I would go, don't I need them to sign it etc?
What else should I ask/check with them before I leave with the V5?0 -

If the V5C is in your name, you just need to pick it up. If it is still in the previous keeper or garage's name, you and the garage need to complete the relevant parts, you keep the green V5C/2 part, the garage send the rest to the DVLA who send then you your V5C.0
