Dealer asked for new logbook and I bought the car before he received it

''Can you clarify the 'recently' in the first line of your first post.
If it was before the 1st of October and you have it dated on the receipt then you have little to worry about.''
I bought the car last wednesday (on the 15th) so I'm supposed to renew the tax, but because the car is still registered under the keeper, ive been told I can still use the car (until the DVLA update their data)... The ''previous'' tax runs until March, so I should have enough time to receive the new log book, even if I wanted to ask for one as well?
''you wont know when the system is updated but if its longer than 5-7 days ago since the dealer took ownership then the likely hood it could be registered in the garages name at present or sometime soon theres just no physical v5c to confirm that yet. ''
That's what I thought as well. The garage bought the car the week before I bought it from them, and it takes at least 2 weeks for the DVLA to update their data so the seller told me we should get a log book in the next 10 days. (DVLA says 6 weeks!)
Now I had a look on the DVLA website, when I enter the car's registration number:
- the MOT date has been updated (the garage got it MOT'ed for me just before they sold it to me)
- but the tax date is still unchanged; also rang the DVLA and they told me they still havent receive anything. I tried to find out if the old owner contacted the DVLA (because that's what you should do when you sell your car?) and she wouldn't reply to this, only answer was, you have to wait for 6 weeks!0 -

The normal turn around for the DVLA can be about 2 weeks, but if someone who is not the registered keeper applies for a V5C, the DVLA write to query the application with the registered keeper and give them time to reply, that can take about 6 weeks.0 -
Oh I see; so they would have to check first with the previous owner if he's sold the car (he should have done at least 2 weeks ago).
What are the cases when the DVLA refuse to send a new V5C after checking with the previous owner?
I dont mind to wait, as long as im 100% sure I'll get a logbook..0 -
They give the registered keeper about 4 weeks, if there is no reply, they send the new V5C.0

That's good to know thanks. So in any case I should receive a V5.
The most frustrating is to wait that long without knowing where they're up to in the process0 -
As you bought it after the 1st the tax is non transferable, so technically the vehicle isn't taxed under your name and thus you will have a fine for no VED if caught using it on a public road. if you say your are the previous owner, you dig a deeper hole in attempting to defraud HMRC and get in trouble for lying to the officer dealing with you also.
Technically the vehicle doesn't have tax eventhough it appears to be taxed, due to new rules. effectively the previous owner is in the process of claiming a refund and when this is processed during that time of your ownership/first becoming registered and your not showing as holding VED without SORN is subject to a fine so I would take it off the road and SORN it to your address until you receive V5C then when you get it and VED is bought the SORN will automatically get lifted. this is what my interpretation of the rules are in this situation without V5C details your at the mercy of the transfer process.0 -
Cars without a V5c tend to sell for less at auction, as the dealers are expecting to have to store the car until they can complete the V62 procedure to get a V5.
I'm surprised that the dealer has sold you a car which is still in this process. And surprised you bought it. As you've now discovered, you're in a strange place - the car is probably untaxed, and you might not get the payout you want from your insurance company if you were to be in an accident.0 -

Open 8 till 2 today, if it was me, I'd ask the people that know and may be able to assist.0 -
Thanks Scotsman, I rang yesterday, I wanted to know if the previous owner contacted them to tell them he sold this car, I also wanted to know if they received the V62 form from the garage (to apply for a new log book for this car), the only answer I got was '' you'll have to wait 6 weeks and call back in 6 weeks''.
She asked for my name and told me the car wasnt registered under my name, which I knew already. So the DVLA hasnt been very useful0 -
Ok, so I called the DVLA back, asking if they received a V62 form from the garage (sent about a week ago before I bought the car). They told me they couldn't confirm if this was received, as it wouldn't be in their records yet.
I also asked if the previous owner contacted them to sell the car, and they couldn't reveal this information.
Then I asked if it would take less time if I applied for a log book myself (and then come back with my name on it) rather than wait for the garage to get it, and she said it would take less time (although the garage asked for one at least a week ago, but in their name since I hadnt bought the car yet)0
