Dealer asked for new logbook and I bought the car before he received it

Did you ask if the car was taxed?Ok, so I called the DVLA back, asking if they received a V62 form from the garage (sent about a week ago before I bought the car). They told me they couldn't confirm if this was received, as it wouldn't be in their records yet.
I also asked if the previous owner contacted them to sell the car, and they couldn't reveal this information.
Then I asked if it would take less time if I applied for a log book myself (and then come back with my name on it) rather than wait for the garage to get it, and she said it would take less time (although the garage asked for one at least a week ago, but in their name since I hadnt bought the car yet)0 -
The lady told me it's not taxed anymore (because now she knows the RK ill change), so she confirmed I couldnt use the car in the meantime.
So now I could either send a V62 form and pay the fee (and the V5 will come back straight with my name on it)
Or wait for the garage to receive the V5, fill out the paperwork and send it back to the DVLA. I could probably use the car while waiting for the logbook to come back?0 -
Rang the dealer to talk about the tax, he told me I could still use the previous owner's tax (still valid) because the car is still registered under his name.

Yes that's what I meant, DVLA told me its quicker to send a new V62 form from me so I can get the logbook with my name quicker, but this will take up to 6 weeks;
whereas the garage already sent the form, so when the V5 arrives I could use the car (and tax it) using the slip while waiting for the logbook with my name comes back0 -

which is what the OP did, they (the garage) told him wrong to shift the car out the door that it was OK to use the tax when it wasn't so effectively OP would be in this state even if the car wasn't told it wasn't tax.0 -
The garage should not have sold it until they were able to provide the V5. This is why cars with no V5 are cheaper at auction - the traders know that the car will have to sit around for 6 weeks or so before they can be sold.This is where the rules fall apart, if you want online tax then do on-line log book changes.

The garage told me it would take another 10 days or so to receive the new logbook (again, they sent the V62 form a week before I bought the car). But that cant be right if it takes up to 6 weeks.

It would be for the normal change of owner where the V5C is completed and sent off at the time of sale, but the DVLA write to the current registered keeper to check, if someone else applies for a V5C in their name. And that can take 6 weeks.
It may be that the garage asked the seller (if they were the registered keeper) to apply for the V5C in his name, in which case it could be about another 10 days.0 -
I dont think the garage got the previous owner to apply for a V5, i think the garage filled out the V62 form and sent it.
When I asked where the logbook was, i remember the seller telling me it's either with the DVLA (the keeper sent it) but in case they applied for a duplicate and paid the fee, in which case I was sure to receive one.
When I asked when I could expect to recive it, he told me this could take about 10 days (if waiting on the duplicate) or only a couple of days (if its with the DVLA)0
