Think I've been sold a fake / mis described lego - when should I open dispute?

I wouldn't go along the fake route when you return it as ebay will require you to get proof the item is fake. It is not that the item says lego on it and is a fake copy, it's that the product idea is a copy if you understand me. The seller put Lego in the Item Specifics under Brand and it is not Lego. So open an SNAD saying not the stated brand not that it is fake. As long as you send it tracked it doesn't matter if they won't accept the return as long as tracking says delivery attempted.0

Just to add to this don't open the SNAD case until you have received it as if the seller doesn't send it you'll then have nothing to return!0

It is a lego replica rather than a fake. A bit like people who advertise those rubbish megabloks as duplo!
All the same, the advert implies that they are selling lego technica, and there is no mention of it not being lego like in other adverts for the same thing.
The replica bit is just referring to the model being a replica of a ferrari, not a real one!
I would refuse delivery of the item if possible, as this is not genuine lego.

Thanks - the seller responded to my 'this is real lego, isn't it?' question admitting that it's not and immediately offered to cancel & refund, which he/she has done.
So all's well again (as is the forum again, hurah) - thanks for everyone who took the time to reply!0 -
Really glad you got it sorted and your seller saw sense and refunded.
We had a problem a while ago with a toy but on BIN at over £80. The seller claimed it was in good condition but sadly it arrived broken, glued together and filthy dirty. The seller refused to refund, admitted it had been listed by their 13 year old son and told us to resell if we were unhappy. Luckily we followed the advice on here and ebay forced the seller to refund and even provided us with a return postage label.
Some 12 months later the seller relisted it and got £20 which is probably all it was worth.0
