Think I've been sold a fake / mis described lego - when should I open dispute?

    Yeah but if the seller doesn't play ball and refuses to accept the return. The buy won't be able to prove its been returned and will therefore lose a claim.

    The easiest way is to get proof its fake Lego, lodge a claim and they are not obliged to return a fake.

    But don't new eBay rules means that they'll refund it anyway, even without consent from the seller if they don't co-op?
    I'll let eBay / PP figure that bit out - I'm just trying to figure out if I'd have a valid claim for mis-described,
    Acknowledge it says 'replica', but surely if you were being upfront, you'd say it's 'replica lego' not 'lego replica ferrari'

    Maybe I'm clutching at straws - but do think it's very poorly described at 'best' - they've not made it clear at all that it's not real lego, but have implied it is through their own descriptions.
  • They've not made it clear I agree, but they did provide photos of the booklet which you know is fake.

    Maybe Lego has changed since I last saw it but the pictures look like cheap crap.

    I know that now, but didn't before - you even had to ask me what it was made me think it was fake - it's not obvious at all, I don't think.

    Oh well, I'll see if they reply to me - if not I'll take it up with them when it arrives!

    That's because I havent played with Lego for 30 something years.

    No, weird.

    I typed something in about the difference between starting claims in Ebay or Paypal. A few years ago one required the seller to prove something was genuine and with the other the buyer had to provide evidence it is fake. It was obviously best to put the onus on the seller.

    It may be that this is out of date information but perhaps a regular could comment on this.

    Hope this post makes more sense!

    Come on people, it's not difficult: lose means to be unable to find, loose means not being fixed in place. So if you have a hole in your pocket you might lose your loose change.

    it was actually finding that listing that made me realise that's what I'd bought - I was scratching my head trying to work out why that set was selling new for half a used (genuine) set. Very frustrating.
