Think I've been sold a fake / mis described lego - when should I open dispute?

Hi, won an auction on eBay, thinking I was buying Lego Technic
I've paid, but looking closer, I think it's a fake set (of a genuine lego set)
The title of the auction states 'lego technic' and the description says 'SALE Technic Lego Set Replica Ferrari Enzo 1359 pcs 8653'
.. but looking at the photos, it looks to be the fake nights riders set
Would the fact the description states it's Lego Technic, and quotes the set number, be enough to file a 'not as described' case? Or does the 'you get what you see in the picture' card trump this?
Assuming I can - do I need to wait until I receive the item before I can claim?

If it's fake you've a right to make a claim.
You need to get evidence it is s fake, most likely from Lego or an authorised supplier. Unless of course the seller will refund without it. By starting a claim you won't be under any obligation to send the fake back.
Two things, wait and do it correctly but as you haven't recieved it can you cancel the order? Or refuse delivery.0 -
Thanks, it's a used set from a private seller (I think), with 'no returns' policy, so a simple order cancellation may not be possible.
I don't think they've dispatched yet - so could drop them a mail, just don't want them to get all defensive when I don't actually have the product yet.
For what it's worth, this is the listing. Pictures show the instructions, which don't say Lego on them, hence why I believe it to be fake0 -
I've emailed the seller casually asking them to confirm it's real Lego - perhaps they don't realise themselves, so I'll give them the chance to save themselves the postage costs!

(and just in case it's only me - I can literally only see a mass of explanation marks with the odd letter)
