Think I've been sold a fake / mis described lego - when should I open dispute?

Full description.. I suspect the irrelevant blurb was a rouse to disguise the fact it's a fake set.

I BROUGHT OFF EBAY FOR A GIFT FOR MY SON AND THE ITEM WAS FULLY BUILT BUT COULD BE BROKEN DOWN TO RE-ASSEMBLY WHICH WHEN I WON AUCTION I ASK FOR DISMANTLE ITEM. WHEN I RECEIVED ITEM THE MODEL WAS PARTLY DISMANTLE AND HAD A NUMBER OF PARTS LOOSE AND I THINK 4-5 PARTS BROKEN AND LOOSE IN BOX

I EMAIL BUYER AND HE SAID HE HAD PUT IN EXTRA SPARE PIECE/BAG OF PARTS I HAVE LOOKED IN SOME SEALED BAGS AND THINK THE PARTS WHICH ARE BROKEN ARE IN BAGS.

I AM SELLING THIS BECAUSE I WANTED MY SON TO ASSEMBLY FROM START

THE MODEL I WOULD SAY IS 85% COMPLETE WITH EXTRA SPARE PARTS IN THE BOX WHICH I HAVE SHOWN IN PICTURES COMES WITH MANUAL.

THE MODEL MEASURES 18" LENGTH AND 9" WIDE

IF YOU HAVE TIME TO SORT OUT WHAT'S WHAT THIS IS FOR YOU.

How can you tell it's fake from that?

Is the book the instructions or third party advertisements?

I think you'll need to have the physical item to prove its fake.

It's definitely not lego technic, it's a generic version the box and manual don't claim to be lego technic. They should not have described it as Lego Technic so definitely misdescribed.

Lol at the instructions "toys series with strong sense of playing".

No cold feet at all - the description led me to believe I was / am buying a genuine Lego set.
But I now believe it's not Lego at all, so am rightly a little annoyed. Both at myself for not quite spotting it, but of course at the seller too.

So would your view be that this would be fine per description?

You're not allowed to say replica anything so it's not a problem as far as ebay are concerned, if it comes and you open an SNAD they will say return it.

Yes, perhaps - I personally read it as a replica ferrari - which is what it is - but reference to Lego Technic is made in the title, description, and under 'item details - manufactures theme' - plus reference to the official set ID, so feel I had reasonable basis for thinking I was buying a legit product (
