disruptive passenger claim

I had a disruptive passenger on a recent Monarch flight, she made me very uncomfortable throughout a long flight by constantly kicking and slapping the back of my seat, she was an adult, not a teenager, she also resorted to verbal abuse throughout. My fellow passengers were also uncomfortable and eventually offered to swap seats with me,only towards last 45 minutes.
I have since been complaining to the airlines customer relations dept ,they intially only offered me £50 compensation which is a joke, I have asked for a refund or free flight. They have not agreed.to this.There was another passenger on this same airline recently who set fire to someone.
I am now thinking of taking it to a small claims court as there is no further correspondence, it is a deadlock.
Any advice?

    I say move on. Take the £50, what would you expect them to do now ?

    As for the person setting fire to someone else, what does that have to do with anything ?
  • First question is was there anything the cabin crew could have done? I am guessing there was no other seat available as you would have moved but was there a seat in a higher class that they could have offered you instead. If not then you should probably take the £50 and forget it but if there were seats in a different class then maybe the court route is the way to go as it tends to focus the mind of big companies to settle out of court with an improved offer. May not be your free flights though.

    Why do you encourage court action for civil cases addedvaluebob?

    Some guy had an annoying flight and got £50 compo out of it - I've idly sat there and kicked a seat and got up energetically pulling their seat back (as I need it for leverage ;) ) when the idiot in front does a full recline in economy.

    If she was swearing a lot and violently hitting the seat all flight they should have complained to crew to get moved (if there were spare seats) or get her to behave - if she started being abusive towards the crew they'd probably have diverted the flight and had her arrested for air rage so another long flight and delayed holiday.

    People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair.     Because all complaints are basically a game of bluff, I complain, big company says get stuffed, I say still not happy, they say tough, we go through complaints procedure, still not happy, big company says take it or leave it, don't need your business. Sometimes, if people feel strongly enough they should be encouraged to take action as it is sometimes the only way the big companies may learn lessons and change.

    Just in passing, if you don't want the idiot in economy to fully recline their seat and spend the rest of the flight 'kicking the seat and energetically pulling the seat back for leverage' pay the money and upgrade and don't take it out on the people who exercise the same rights as you for the seat they have paid for.

    Threatening court action for a civil issue of compensation over an annoying flight is nonsense, more so when the company calls your bluff. Far better advice would be to write to a paper like the Observer or Times or Telegraph in the consumer rights bit and see if the bad publicity gets more leverage.

    It's all well and good to say that when you have the cash for business, not when you've saved all year for a holiday and have to fly in economy. Making the leg room so small it means the flight is actually physically uncomfortable (crushing you knees) or so you cannot use facilities like the tray table or video screen (which I apparently paid for) is bad manners pure and simple. Expect the air con blasting on your head and many movements out of the seat from me to stretch my legs if you sit in front of me and fully recline without warning, especially from take off to landing. Reminds me to invest in some of those leg defenders that stop reclines. More companies need the newer designed seats that simply slide forward to the person who demands an extra few degrees of incline simply loses their leg space or like Ryanair and Monarch and buy planes without reclines.

    You were a bit annoyed by another passenger, someone else was set on fire. I know which person has reason to complain.

    So if someone does exactly what they are entitled to by reclining their seat you spend the rest of the flight getting your own back with 'passive aggressive behaviour' and you seem to think that is acceptable. Either don't fly or spend the money.
