The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply in full to transactions of less than £42. However it can be argued that because First Choice EPC also charge a further £9.95 to see the EPC then the total of the transaction is greater than £42.

I filled in the online form for my epc on the first choice epc website and decided to go ahead, a couple of days later the assessor called me to arrange an appointment. Never at any time did i receive an email about paying the £9.95 booking fee it says you pay when its booked! The assessor come and i paid him £30 on the day. As far as i was aware this was fine as on the website it says dont pay anything until the day of your epc.
Last night i found an email in my junk mail saying i owed just shy of £200 for failing to pay and charges for late fees. I had until today to pay it overwise it would go up to £450! Apparently they had sent me an email previous about paying which i cannot find! Ive been trying to call all day and have sent many emails and heard nothing back, ive now had an email saying they are going ahead with court action! I emailed back saying could they contact me regarding this and got a reply saying they cant answer any question and i should refer to the terms and condition i accepted! Im not very happy and have not stopped worrying, i can see many people have had problems and it looks like fraud but can anyone help me with what is likely to happen please. Is there a chance it will go to court?

another victim here with the same story to tell so I won't repeat what is already known. I have reported it to Action Fraud and would urge all to do the same.
A few minutes on the www has identified the con man behind this - [TEXT REMOVED BY FORUM TEAM] - google him and you'll see what I mean.
He has a new business Savi (Hertfordshire) Ltd, savi.co.uk which is registered with the Property Ombudsman who helpfully provide a mobile telephone number for him. How can I be certain this is the guy? - the weight of evidence available online is comprehensive. Please do your own research though!
savi.co.uk list their address as Maylands Business Centre, which used to be the address for First Choice and EPC Local before 'moving' to Malaga but Companies House have a different one, the T&C on savi's website look very familiar as well, especially the references to Energy Performance Certificates.

Most emails are from First Choice EPC but some are sent from [TEXT REMOVED BY FORUM TEAM] whose real name it is believed, to be [TEXT REMOVED BY FORUM TEAM] who was declared bankrupt in 2011.
If this conman wants to send anyone to court for non payment, how do you think the judge will react!?!

Your comments will be passed to [TEXT REMOVED BY FORUM TEAM] for him to decide whatever course of action he deems appropriate.
In closing, i would like you to consider how you would feel if somebody posted factually incorrect information about you or members of your family on the internet only for those very same comments to be embellished and blown out of control by other hell bent on manipulating the truth. Furthermore, how would you then feel if those same members of your family were harassed and bullied because of personal information that had been leaked about them. I really think you should have given more thought to your intended course of action before putting yourself forward as the peoples champion.

Further to my earlier email, and as a courtesy to you i decided to look into your order in more detail to establish if there was indeed a rightful claim for a cancellation fee and it transpires that indeed there is. Furthermore, it appears as though you placed your order on 1/7/14 and commenced marketing of the property for rent on 2/7/2014. Further investigation on Monday will determine whether or not you breached EPC legislation. People in glass houses really shouldn't throw stones Mr Shaw. We will also ask our collections department to perform a track and trace search against all known addresses in order to ascertain your current address for collection purposes.

Perhaps they don't understand the legislation they are quoting - you have 28 days from commencement of marketing to produce the EPC, otherwise there is a possible £200 fine if anyone can be bothered, which I very much doubt. And there is a 6 month deadline for imposing this fine, which again makes it unlikely that Trading Standards would do anything.0
