Your the first case but you have nothing to lose and yes Ee will submit a defence and it will be long it'll be largely irrelevant and its whole aim will be to discredit rather than dedend their actions. But...RC is pretty good at this to just wish you'd applied for compensation as you'll be setting the precedent now!0

Got my reply this morning as I've put claim into cisas in May have closed the case. I've got 6 months to go on my contract can't wait to leave!!

[FONT="]The company has objected to your claim being dealt with by CISAS as the subject of your dispute has already been considered under the scheme. They stated the following:[/FONT]
[FONT="]Having reviewed the above claim, we note that M[FONT="]iss xxxxxxxx[/FONT] has already brought her dispute to CISAS in May 2014 (under case reference [FONT="]xxxxxxx[/FONT]) and is now looking to make an additional claim from previous CISAS claim. [/FONT]
[FONT="]It is our understanding that such a claim is to be rejected as outlined below, and therefore we kindly ask that the matter be withdrawn from the scheme accordingly. [/FONT]

I think that is the first time we have seen correspondence from EE to CISAS. It does read a bit like EE reminding CISAS of their "gentlemen's agreement" not to accept these cases! I also note that CISAS do not confirm that they have checked their records, but rather accept EEs assertion that the cases are the same.
If it was me I would CALL CISAS today and ask them to explain:
Why they have accepted EEs claim that he case has already been adjudicated on without seeking your response first,
How a claim under the NEW price variation clause has anything to do with the OLD price variation clause and the change in T&Cs.
I think I will phone Ofcom today if I get time
