I've looked at the PIP but I find it very confusing. As some of the criteria I can't do and others I can but it causes me alot of pain.
Yes I am still under a consultant, being referred on to a specialist and I attend physio once or twice a week.
Yes it seems like its going to be a long term problem and they have told me to only expect to gain 80% use back.

If the company pays his tax and NI I would question whether he is self employed or an employee, sounds a but suss to me.
Does he get paid holidays.
The Contruction Industry Scheme is a special scheme for subcontractors in the construction industry by which the main contractor- otherwise known as employer- deducts tax and NIC from the payments,( which ensures these amounts are paid )
The subcontractor is treated as self empployed by HMRC.
He completes a self assessment return each year to confirm whether too much or too little tax has been deducted.0 -
All tax deducted will be set off against tax and class 4 nic due , as assessed under self assessment.0

It sounds as though the main stumbling block is the mortgage payments, can you discuss with your provider and request a holiday or reduced payments for a while until your back on your feet with reduced outgoings.
A visit to a debt adviser to assist with reducing the non priority debts is also an option.Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.0 -
His employment status is all completely above board and pretty standard in his industry, he doesn't get paid holidays or sick pay, they definitely pay his tax on his behalf and I think he pays his own NI.

We requested a holiday period before and it was denied, I can;t remember the reason why, but we may try again thank you. We can't reduce the payment as were paying arrears as well.

If I understand the facts right, there is no point in applying for ESA.
Because you do not have enough contributions and your husbands income is too high, you will not be paid.
If the child benefit is paid to you (or is transferred over to be paid to you), then your pension contributions will be paid by that.0
