You do but the retailer has the choice of remedy unless its right at the beginning of the contract where the reasonable time to test an item comes into place. After that they retailer has the choice to refund (can offer a partial refund to take into account the usage), replacement or repair.

Obviously most of the time they go for the cheapest option to them.
