    You're going about it the wrong way. Your priority should be to look for a job ideally full time and then decide what to do. Either your ex agrees to you claiming for one child and you pay for half the childcare for the days it is required or she pays it all. Both of you should be looking at working the most his tout can rather than fighting for who can do the least and claim the most benefits and/or from each other.
  • so you say get a job for £210.00 with wtc deduct outgoings rent£100,council tax £25.00,utilities gas/elec etc £30.00, car petrol/insurance etc £30.00(conservative),tv licence £2.00, Internet and phone £10.00,clothing for children £10.00, food sorry I cant eat so I can feed my children and have no money for any contingencies


    total deductions £207.00


    yippee I have £3.00 left to feed myself and my children all because I don't have the cb book

    You need to cut down on your outgoings. Why do your children need £10 a week for clothes?

    You might be able to get some help with rent and /or council tax.

    Have you explained your situation to your ex?

    you would et housing benefit and council tax support on that income.
    as has been suggested ... dont buy the children clothes as their mother receives the funds for this.
    4 dinners a week doesnt cost much. you could feed all 4 of you for 2 days for a fiver
  • it was a rough estimate just to show expenses, I did not list all like cleaning products, toiletries, haircuts, activities for the children and both myself and the children need clothes. so I think £10.00 is a fair price on an annual basis.
    what about birthdays and Christmas presents.

    You are not the main carer of your children, that's why you are not entitled to child benefit or child tax credit. There's not much point complaining about it to people on here, it's a fact.

    The best way forward is to get a job and then you will be earning money to pay your bills, which include money to pay for your children's food when they are with you. This needs to be a higher priority then Christmas presents or haircuts.

    The main carer is generally expected to pay for the children's clothes and after school clubs. That's part of what the child benefit and tax credits go towards. If you genuinely think that you can't manage on a full time income, then perhaps do a statement of affairs and people can help you work out where you can cut back.

    you need to accept that they are NOT going to give you any more benefit.
    you need to either convince your ex to share the benefit she receives or get a full time job and let her arrange her own childcare.
    if you cant come to an agreement you need to seek mediation for the childrens sake.
    your ex being unreasonable and you being a doormat does not entitle you to extra benefit

    They're not saying that. Your income is all that amtters for those benefits.

    Mediation is what is needed here, not a CB tribunal. The law is being applied correctly, and that is all the tribunal can consider.
