Ebay - Paid extra for first class postage but didn't receive it.

I ordered an item on Thursday morning that I needed for Saturday, so paid £4.95 to have sent first class, rather than the free second class option.
I received an eBay notification on Thursday afternoon saying my item had been dispatched and the estimated delivery was the next day, as you would expect with first class.
The item didn't arrive until this morning (timing consistent with being posted on Thursday 2nd class) and there was a self printed ebay postage label on it with a royal mail signed for sticker over it. I peeled back the signed for sticker and the corner of the printed label says second class.
I emailed the seller expressed my disappointment and asked for a refund of the £4.95 I had paid for first class delivery.
The seller mailed back saying it HAD been sent first class. I responded with a photo of the second class postage label.
They then came back and said it had been posted first class and the second class label was a "mistake". The delayed arrival time was due to "a holiday on Saturday" (?). And if I didn't want the item I could return it at my own cost, for a refund.
I sent a final reply asking again for a refund of my £4.95 so I don't need to open a case and leave appropriate feedback.
I have a feeling they won't play ball. Note this is an experience business seller with over 5K feedback (99.2% positive)
not sure how to proceed here, should I open an item not described case?

In all fairness to the seller, 1st class does not guarantee next day delivery it never has.
If you wanted next day delivery you should have opted for a service that provided that.
And whilst sending second class isnt on at all, its nothing you can open a case for.
Request a refund of the differance between 1st and second class is all you could ask for.0 -

Hi Alykatz, yes I appreciate this, but as I stated in my OP there is a 2nd class franking label on the package, which along with the second class delivery time frame, makes things pretty clear!
Again, as I stated in my OP, second class delivery was FREE. I paid £4.95 to upgrade the delivery to first class.0 -

If you open a case all you will be told is to return tracked at your expense for a full refund.
Although to be fair this is not a reason to open a not as described case.
And 1st class can easily take a few days to arrive it happens to me all the time, 2nd class can take a good week.0 -
If the item was sent signed for, the seller will have a receipt with the tracking number on, this will tell you if it was sent 1st or 2nd class, as even with a self printed ebay label, the signed for (recorded)parcels still have to go through the post office systems to issue a receipt0

No they dont. They can go in post boxes or be collected.0 -

If you paid extra for 1st class, and it was sent 2nd then you have every right to reclaim this money. I would open a dispute and reflect ytour experience in the feedback.
It may not mean that it would have arrived by Saturday if it had been 1st, but that is a side issue.0 -

Item isnt NAD and besides which all ebay will do is say return at your own cost tracked for a full refund as i stated earlier.
There is no way to force the seller to just refund the postage element.
Accurate feedback is the really the only option if op wants to keep the item.0 -
Thanks guys, I have opened a case, and will give ebay a call tonight to see what they advise / predict. I'll keep you updated of the outcome.0
