away from what and why, d4zza i would say that it is the selling dealer or the garage that you bought the car from that should be dealing with this
i would be telling the dealer that you bought it from that it is down to them to sort it out because your contract was with the dealer not with the manufacturer
if the dealer wants to fight the manufacturer then that is up to him and not you, I would also be asking for a loan car in the mean time while they sort this mess out0 -

No real idea personally, had it explained to me, but being a non-expert, I've no idea. Something to do with the parts moving in all directions or something. It's some sort of super-duper double clutch automatic thing!0 -

I know that and this is why the manufacturer has refused a warranty repair, they are saying that the car was serviced outside the manufactures network using parts of unknown quality
regardless of that fact the OP has a case against the garage that he bought the car from
this is a case of the garage that sold the car trying to pass the buck when it is him that should deal with it

if the service part was fitted prior to the garage selling the car then they are at faultWhen you buy a second hand car from a dealer, you have the right, under the Sale of Goods Act, to expect the car to:
be of satisfactory quality (taking into account its age and mileage)
meet any description given to you when you were buying it ( whether in the advert or in discussions prior to sale)
be fit for the purpose (for example, to get you from A to B safely)

If the second hand car does not meet these requirements, you have a right to claim against the dealer for breach of contract.
the engine of a sub three year old car with 16K has failed within three months of purchase so it is not of satisfactory quality and is not fit for purpose0
