    74jax anything jointly owned passes to the survivor. When DH died I just took the death certificate to the bank and they took his name off our joint account. Unfortunately this also happens with debts. Any joint debts pass to the survivor also.

    I actually knew his online banking access details and once we found out his illness was terminal he told me to empty his accounts so I did :o

    Shortly after he died I saw a solicitor to draw up a new will for me. My simple one was no good any more, being the surviving parent we had to draw up a trust arrangement and guardianship details for the children just in case.

    I'm sorry he's being stubborn about it. Some of my friends still don't have wills, they think "these things won't happen" even though, here I am, widowed in my 30s with two littlies. It does happen. Out of the blue. We had three weeks from terminal diagnosis to death. Some people don't get any advance notice at all :(

    thanks for the info, there is never any balance in this account, it just pays out monthly direct debits. It's really handy to know what happens though . Thankfully we have no debts. All his other accounts are in his name and we each own one home, not in joint names

    I'm so sorry for what happened. He is very aware it could happen any time, healso has a very 'risky' hobby and knows people who have died doing it . It honestly comes down to he just can't specify I want x to get 10%, and y to get 10% etc.

    It's weird, as he is clued up on everything.

    I've never had one because I wasn't in a position to leave anything. I've since inherited a house and some money so am drafting up one to leave everything to my children equally
  • I had my appointment to get my will drawn up on Monday, took all of 5 mins, just expressed my wishes as to who I wanted to benefit in the event of my death and who I didn't and a draft is being drawn up. Will cost me 80 quid through will relief Scotland.

    Was this thread that gave me the shove to do it so thanks for that.

    Some people have an aversion to making a Will because they think they moment they have made it they will drop down dead. It's being very selfish to those who are left behind. I don't know what you can do to persuade those kind of people to change their minds short of regaling them with the misfortunes of others who have had to suffer all kinds of financial hardships when somebody has died intestate. If somebody truly loved and cared for you, they would not leave you in this position.

    It's not financial hardship i'd be left with, i don't really mind his mum would get the majority of the money is he died without a will, it's the having to sort the legalities out without one.

    Just an update - solicitors appointment was this morning and that was the easiest part of the process.

    I just had to tell her what assets I had, who I want to be executor, who I wanted to inherit and how (and did I want to leave any kids out, as thats a separate issue on its own) and who I wanted to appoint a guardian.

    Dead simple. I just have to wait for the copy that she will send to me at the end of the week hopefully (as mine is quite simple), then pay and sign!

    Make sure you check the draft carefully for any mistakes.
  • I have a six figure estate, no will, and I'm going for heart surgery shortly, but I can't make up my mind what to do.
