    Hi all, thanks for the replies...

    Basically I have a credit card statement which shows I bought it, plus receipt from the garage...I am assuming the best way of dealing with this is small claims court?

    There is no spare key I am afraid, I live northampton she lives rugby now, so not just a short drive away.

    She refuses tongue it back as I said she could have it (I did until she refused to give me the full amount and just upped and left). I have text her, rung her etc to try and sort it out, she ignores me.

    We still have six months left on tenancy and I have a feeling she will screw me with that too.

    One other thing, if I report it as stolen is that not a lie?

    Would this not come under a domestic thing with the police?

    I assume you've offered to give her back the money she has already paid?

    I doubt the police would get involved in this when you've both paid money towards the car.

    Plus you've verbally said she could have the car which if you told that to the police would not help your case.

    Your best bet would be a small claims court to try and obtain the shortfall in the money as opposed to getting the car back.

    Yes I've offered, it's a catch 22, cos if I transfer it to her bank, she may well keep it and the car, if I don't pay it then she has given me money.

    To clarify, she did not help me pay for the car, I borrowed money from my step mum and put it on credit card.

    I did verbally say she could have it, yes, but there is nothing in writing.

    Also, how do I obtain the shortfall as there was no written agreement, just a verbal one.

    If you can prove how much you paid for the car and how much she has given you for the car then it should be pretty easy to prove there is a shortfall.

    Perhaps the small claims court then. You can do it online can't you?
