Parking Charge from PCS - received 6 months after?!
Comments
-
Hello LillyJo - well done for getting stuck into reading the newbies Threads and welcome:-).
From#1. Is this a typo?
' a parking charge was placed on windscreen or sent by post (neither of which is true), and no payment has been received by the driver and now opportunity to pay reduced amount has passed and full amount of £120 is now due!!!' - yours or theirs?
I'm sure you'd happily receive £120. me too, but just settle into more reading and esp. look at the scams pulled by this lot, especially saving on postage by not sending docs as later claimed.
Forum Threads on PCS aka Debt Recovery Plus - check both.
They are high up on bazster's List of Liars I think?
Also is it headed Notice to Owner, or Notice to Keeper?
#
At POPLA stage it's handy to know what signage etc. is in place, or was at the time. Can you go there again without too much trouble?
Sorry that was a typo! Should have typed 'received from the driver'!
It's headed 'Notice to Owner'
Can't get there to check the signage at this present time.0 -
It seems to me that you need to send the appeal as per the newbie thread, adding in as either a new point a) bumping all the others down or as point d) something along the lines of the following. (someone else may word it better than I) :
This is the first notification I have received of this alleged incident. As this was received xx days after incident, and has been issued in breach of POFA 12, there is no keeper liability and I decline any debt to PCS.Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. 100% agree with Dee. Naughty Stroma for asking who the driver was!
Ask for a POPLA code with your appeal. If you do not get one, complain to the BPA. Debt recover Plus are the nasty end of the PPC business. They actually resigned from the Credit Services Agency so you cannot complain to them as well.Dedicated to driving up standards in parking0 -

POFA 12 is explained I newbie thread
You can compare your NTK (which it isn't really) to this
http://www.legislation.gov.uk/ukpga/2012/9/schedule/4/enacted
Section 8 or 9 depending on whether windscreen or not. But since you don't seem to be sure it is hard to say. But either way as keeper after all this time you are no liable. Only driver is liable and you do to have to declare who that is, whatever the PPC say!Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. You just need to take a step back off this thread and read the 'Newbies' sticky thread and send the template appeal. This is not much different from any other late Notice to Keeper. PCS are known to use their 'Notice to Owner' version when it is too late for POFA 2012 to establish keeper liability. They have a 'Notice to Keeper' as well for cases where they've joined the party in time. Not here though - so only the driver is potentially liable - so the keeper's POPLA appeal is a slam-dunk win.
Interesting to see a different PPC for a change though:

''our signage clearly displays a 24 hour deterrent to unauthorised vehicles.''
Sure it does...and next they will be telling us the extortionate amount = their 'loss'!
And as for the amount - it exceeds the £100 ceiling allowed by the BPA as well so a complaint to the BPA is in order:
''now opportunity to pay reduced amount has passed and full amount of £120 is now due''
They can't say that in the first letter to the keeper. This is a serious breach of the Code of Practice IMHO and you should email the BPA as well as sending the template appeal to the PPC. You can add a point 'D' to the template appeal to PCS, about the sum of £120 exceeding the appropriate amount allowed by the BPA. Email addies for the BPA and DVLA are in post #6 of the Newbies thread at the top of this forum (the top FAQs post you should have read first before hitting the 'new thread' button. The one with the appeal template for you to send).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
