Parking Charge from PCS - received 6 months after?!

Hi ya

Just want some advice as I've been reading up on all of the newbie FAQ stuff, but can't see anything about my situation. Sorry if I'm being a bit blonde, but just need to clarify a couple of things.

Received a 'Notice to Owner' from PCS (Parking Collection Services) the other day for a parking charge breach that happened on private land (shop car park) over 6 months ago!!!!! It says 'the vehicle was breaching the stated t&cs of parking which were clearly displayed and agreed to by the driver when your vehicle parked on private land managed by our client AM Parking Services Ltd.'

Firstly is this legal, as this is the first notice I've ever received about it - it says that a parking charge was placed on windscreen or sent by post (neither of which is true), and no payment has been received by the driver and now opportunity to pay reduced amount has passed and full amount of £120 is now due!!!

So I was planning to send the shortened template appeal letter to them stating I'm the registered keeper not the driver and this is the first communication I've received about it and for it to be cancelled and mention the POPLA bit too?

On the back it says PCS is a trading name for Debt Recovery Plus.

    Does it state that the vehicle keeper/owner is liable? What is the precise wording?

    It says:

    We have obtained your details as you were the registered keeper/owner of vehicle at the time of parking.

    At the end it says: 'full payment must be made by the driver within 28 days to avoid further action'.

    So haven't they shot themselves in the foot a bit now?

    Was the RK actually the driver as well? And I presume this is England or Wales ?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Does it not go on to say somewhere that the owner/keeper will be liable to pay if the driver doesn't pay?

    Hello LillyJo - well done for getting stuck into reading the newbies Threads and welcome:-).

    I'm sure you'd happily receive £120. me too, but just settle into more reading and esp. look at the scams pulled by this lot, especially saving on postage by not sending docs as later claimed.

    Forum Threads on PCS aka Debt Recovery Plus - check both.

    They are high up on bazster's List of Liars I think?

    Also is it headed Notice to Owner, or Notice to Keeper?

    At POPLA stage it's handy to know what signage etc. is in place, or was at the time. Can you go there again without too much trouble?

    Yeah I guess it could be identified as the exact date has been given. The reason asking is that if the driver is different person any liability could be passed on.

    Yes I understood why you were asking, but I'm thinking this is a tiny operator issuing very few tickets so identification might be a risk.

    No it doesn't mention anything like that. Just that the driver needs to pay within 28 days.
